Urgent need to stop genocide and ensure punishment of those complicit in genocide committed by Daesh

In January 2016 the Assembly approved Resolution 2091 (2016) which states in its paragraph 2 third sentence:

“States should act on the presumption that Daesh commits genocide and should be aware that this entails action under the 1948 United Nations Convention on the Prevention and Punishment of the Crime of Genocide.”

After the Parliamentary Assembly, both the European Parliament and the United States Congress adopted similar texts and called the mass killing of Yazidi’s, Christians and other minorities by Daesh genocide.

 On June 16th 2016 Paulo Sérgio Pinheiro, Chair of the United Nations Independent International Commission of Inquiry on Syria  stated: “Genocide has occurred and is ongoing,”, when presenting the report "They Came to Destroy: ISIS Crimes against the Yazidis".

 Yet, there is no official criminal investigation into genocide by the International Criminal Court (ICC) and there is no special tribunal to deal with the Daesh leadership, the Daesh fighters and those who support Daesh, for instance by supplying weapons and funding.

And as far as it is known, individual countries are not prosecuting Daesh fighters for taking part in an organisation that commits genocide.

 The Assembly resolves to investigate with great urgency ways and means for prosecuting those guilty of genocide and concrete action to stop this genocide immediately and cut off all supply lines to Daesh.

The Assembly also resolves to build a coalition for a referral of this genocide to the ICC by the UN Security Council.

The Assembly should appoint a rapporteur or an ad hoc committee immediately.
