Daphne Caruana Galizia’s assassination and the rule of law in Malta and beyond: ensuring that the whole truth emerges
In the draft resolution, replace paragraph 5.3 with the following paragraph:
"encourages the Government of Malta to take into account both the logistical need for the administration of justice and the Venice Commission's recommendations on the judiciary in making any further judicial appointments prior to the reform of the procedure for appointment in line with those recommendations, and in particular to refrain from making judicial appointments which do not enjoy the support of the Judicial Appointments Committee;"
Explanatory note
The composition of the Judicial Appointments Committee does not go against any common European approach. The current proposal to stop all judicial appointments until the composition of the Committee is changed irrespective of the needs of the judicial system is therefore extreme and unwarranted.
