In the draft opinion, before paragraph 13.2, insert the following paragraph:
"amend article 3.5a as follows: "illegal sports betting" means, for the purposes of this Convention, all sports betting activity whose type or operator is allowed by no jurisdiction that is party to this Convention, such that any sports betting activity whose type or operator is allowed by one or more of the Parties shall not be considered to be illegal;"
Explanatory Note :
Malta reiterates reservations voiced during the Drafting Group. Malta further considers that the current definition is irrelevant to the scope as it does not target betting which entices sports manipulation. Malta proposes betting is not to be deemed illegal when allowed in a State party and thus subject to the controls of the Convention.
