I am pleased to submit to you the list of candidates for the post of judge to the European Court of Human Rights in respect of San Marino:

2. Description of the national selection procedure for the transmission of a list of three candidates to the post of judge on the European Court of Human Rights

9 March 2018

On 17 July 2017, by Decision No. 1, the Congress of State (Government) approved the issuance of public calls for candidates to the post of judge on the European Court of Human Rights and approved the establishment of an ad hoc Selection Committee.

On 25 July 2017 the call for candidates was published through the press, on San Marino institutional websites and was disseminated as widely as possible, through the help of the Professional Register of Lawyers and Notaries Public of the Republic of San Marino, and was posted publicly in the Government Building. Please find below the copy of the call for candidates.

The Selection Committee referred to in Government Decision no. 1 of 17 July 2017 met on the following dates:

  • 26/10/2017: examination of the applications received;
  • 07/11/2017: evaluation of the candidatures, on the basis of the CV received, and definition of a first ranking of the candidates.
  • 14/11/2017 and 22/11/2017: interviews with candidates and assessment of their language knowledge; drawing up of the list of candidates to be submitted to the Government.

The Government, by Decision No. 6 of 5 December 2017, established the list of three qualified candidates, after acknowledging the applications submitted, on the basis of their curricula vitae and of the minutes drawn up by the Selection Committee.

3. Election of the national judge to the European Court of Human Rights

The Ministry of Foreign Affairs and Justice informs that on 20 September 2018 the term of the current judge of the European Court of Human Rights in respect of San Marino will expire. Therefore, the Government of the Republic of San Marino shall submit a list of three candidates among whom the new national judge will be elected.

The Minister of Foreign Affairs and Justice shall submit to the Government, for acknowledgement, the list of three candidates who have been chosen by the Selection Committee referred to in Government Decision no. 1 of 17 July 2017. The list will then be transmitted to Strasbourg and examined by the competent bodies of the Council of Europe. The judge will be elected by the Parliamentary Assembly of the Council of Europe from the list of three candidates proposed by the Government, pursuant to Article 22 of the European Convention on Human Rights.

Applications can be submitted by jurists of San Marino nationality, possessing the qualifications required by the European Convention on Human Rights and by the relevant Resolutions and Recommendations of the Parliamentary Assembly of the Council of Europe.

Qualifications required to submit an application:

1. San Marino citizenship;

2. degree in law, preferably with professional qualification in San Marino;

3. experience in the legal field, preferably in the area of human rights;

4. active knowledge of one of the two official languages of the Council of Europe (English or French) and at least a passive knowledge of the other official language;

5. up to the age of 60;

Moreover, pursuant to Article 21 of the European Convention on Human Rights:

1. The judges shall be of high moral character and must either possess the qualifications required for appointment to high judicial office or be jurisconsults of recognised competence.

2. The judges shall sit on the Court in their individual capacity.

3. During their term of office the judges shall not engage in any activity which is incompatible with their independence, impartiality or with the demands of a full-time office; all questions arising from the application of this paragraph shall be decided by the Court.”

Interested parties meeting the requirements are invited to send to the e-mail address of the Department of Foreign Affairs [email protected] their curriculum vitae preferably in English and in French, in Word format along with a covering letter, no later than 2 p.m. on Tuesday, 5 September, 2017. CVs shall contain professional and private contact information of candidates and be drawn up in accordance with the model curriculum vitae adopted by the Parliamentary Assembly of the Council of Europe:

The above mentioned Selection Committee will examine the applications submitted and convene the applicants for an interview, if necessary, in order to select the three candidates that the Government of San Marino will present to the Council of Europe.

Candidates elected by the Parliamentary Assembly are required to reside permanently in Strasbourg.

Since the entry into force of the Protocol no. 14 to the European Convention on Human Rights, elected judges shall serve on the Court for a single term of nine years. Their term ends, in any case, at their 70th birthday.

Legal advice and notarial activity. Above-mentioned teaching activities (point III, letter b) in the field of gender violence, including detailed consideration of the Council of Europe Convention on preventing and combating violence against women and domestic violence (Istanbul Convention, 11 May 2011).

Several years of experience as speaker, for legal aspects, in seminars/courses periodically organized by the University of San Marino, in collaboration with the Authority for equal opportunities («Authority per le Pari Opportunità») of the Republic of San Marino, aimed at the continuing vocational training of police officers, social-health workers and school personnel in the field of gender and domestic violence (including, obviously, violence against women).
