With reference to the previous communications and your letter dated 26 April 2017, on behalf of my Government, I have the honour to put forward in alphabetical order the names and curricula vitae of the three candidates for election of the judge in respect of the Republic of Albania, in accordance with Article 22 of the European Convention on Human Rights:

  • Sokol BERBERI
  • Darian PAVLI
  • Mariana SEMINI

The candidates were selected in a competitive procedure, from a list of 16 (sixteen) applicants who fulfilled the criteria announced in the call for application. At the conclusion of the evaluation process, the national ad hoc Commission for the selection of the candidates recommended a list of three qualified candidates for the position of the Albanian judge in ECHR. A description of the national selection procedure is enclosed to this letter.

Following the rejection of the previous lists by the Parliamentary Assembly and the Advisory Panel, and going through a fair and transparent national selection procedure the Albanian Government submits this list, with three highly qualified candidates, with relevant professional experience, according to the relevant guidelines of the Council of Europe.

2. Description of the selection procedure of recommended candidates for the position of Albania's Judge at the European Court of Human Rights

To ensure the compliance of this process with the Council of Europe standards

of the Committee of Ministers on the selection of candidates for
the post of judge at the European Court of Human Rights’’; Parliamentary
Assembly Resolution 1366(2004) (as modified by Resolutions 1426(2005),
1627(2008) and 1841(2011); The Copenhagen Declaration (2018); The
Interlaken Declaration (2010); The Izmir Declaration (2011)., these steps were undertaken:

1. The call for application was widely disseminated through the publication at the official website of the Prime Minister's Office, at the institutional web pages that interact with the community of jurists, as well in the media.

2. In order to receive a higher number of applications, the deadline for submission of applications was extended by 1 month, by encouraging professional lawyers that fulfilled the criteria announced, to apply. The application deadline lasted more than two months in total.

3. The qualifications required meet the criteria for the appointments to the highest judicial posts, provided by the Constitution of Albania.

4. Considering the importance of the professional and moral integrity, the control of figure of judges and prosecutors in the Albanian justice system, as well of Albanian representatives in international judicial bodies, under the implementation of justice reform in Albania, in accordance with the Constitution and the legislation in force, applicants for the position of the new judge of Albania in the ECHR had undergone the process of reevaluation (vetting).

Other legal professionals who were not included in the categories mentioned in the Constitution were subject to the principles underlying the reevaluation process, which was conducted through investigation and evaluation of skills, competencies, personality, assets and other aspects, in co-operation with the responsible institutions. An applicant was excluded from the process, due to the reevaluation process (vetting).

5. Under the Order of the Secretary General of the Council of Ministers was established an ad hoc Commission for the selection of applicants with the purpose of recommending the most qualified of them. The composition of the commission was balanced between representatives of the academic corps and well-known law professionals, part of the public administration.

Ms Majlinda Dhuka – Deputy General Secretary of the Council of Ministers;

Mr Armand Skapi – Director, Directorate of European and International Law, Ministry for Europe and Foreign Affairs.

6. To perform the functions of the technical secretariat in support of the commission was in charge the Regulatory and Compliance Department of the Prime Minister’s Office.

7. After reviewing the applications and verifying compliance with the required criteria, applicants were invited to the structured interview stage, according to a standardized format of questions aimed on identifying the degree of motivation of applicants for the position of Albania's Judge at ECHR but also to check their knowledge about the European Convention on Human Rights, ECHR jurisprudence and the way ECHR is organized and functioned.

8. The questions addressed to each applicant are as follows:

Briefly introduce your professional experience including your contribution to the field of human rights (if any).

Which is the main reason you are applying for this position?

Which is the inadmissibility criteria of the complaint before the ECHR?

How do you interpret Article no. 2 of the European Convention of Human Rights, 'Right to life'? – 'The right to life is protected by law'

What is the obligation of the High Contracting Party to respect this right?

In the context of Article 8, which is the right to respect for private and family life, under the European Convention on Human Rights, what is the interpretation that the ECHR has made to the notion of 'home'?

What are the circumstances when the Grand Chamber exercises its jurisdiction?

Do judges sit in cases concerning their own country, at the European Court of Human Rights in Strasbourg?

Choose to introduce one of the ECHR decisions that has impressed you predominantly during your professional career, for the reasoning and the standard setting.

9. Determined to carry out this process under the conditions of full transparency, each applicant was invited to sign a statement by which he/she expressed the will to record or not the interview with digital audio.

10. Foreign language skills were also tested during the interview by developing a part of it (three out of seven selected questions) in one of the official languages ​​of the Council of Europe.

11. The Commission made its assessments for each candidate based on a total score worth 100 points (30 points dedicated for the applicant's application documents and 70 points for the interview).

12. The number of applicants who fulfilled the criteria announced in the call for application was 16 (sixteen).

13. Ad hoc commission, at the conclusion of the evaluation process, recommends a list of three candidates for the position of the Albanian judge in ECHR (in alphabetical order), as follows:

Berberi Sokol;

Pavli Darian;

Semini Marjana.

Herewith below, a brief summary of their qualifications:

Mr Sokol Berberi – one of the most distinguished jurists in Albania; Member of the Constitutional Court (April 2007 – September 2016); Doctor of Law; Professor in some law disciplines; Full time lecturer at the Albanian School of Magistrates, contributor to the approximation of Albanian legislation with the European Convention on Human Rights, Legal Advisor to the Parliamentary Committee on Human Rights, Tirana, etc.

Mr Darian Pavli – lawyer with 15 years of experience in designing, coordinating and implementing activities promoting human rights protection, in New York and Tirana (Open Society Justice Initiative), including the Council of Europe region; legal expert at EURALIUS V, Advisor to the Special Parliamentary Commission on Justice Reform, representation of some cases at ECHR.

Ms Marjana Semini – one of the most distinguished jurists in Albania; Professor in Law, full-time professor at the School of Magistrates for 20 years, Director of the School of Magistrates (2009-2013), Expert of the Commission of Legal Reform, expert of USAID, WB, UNESCO, EBRD etc.), followed different courses on human rights, author and co-author in some articles.

The three recommended candidates responded very accurately to all the questions addressed by the ad-hoc commission during the interview, in Albanian and English language, showing the depth knowledge on ECHR jurisprudence, how the ECHR works as well the role and competences of judge at ECHR.

14. Here we submit the above mentioned list for consultation, by Advisory Panel of the Committee of Ministers of the Council of Europe.

I have extensive litigation experience as an advocate before international human rights courts and mechanisms, but no direct experience as a judge. I have conducted several trainings of judges and other law professionals in the Council of Europe area, mostly on questions of ECHR jurisprudence.

Advising and assisting the Albanian Parliament, Ministry of Justice and other justice institutions with implementation of the justice sector reforms and other strategic matters
  • 2017–ongoing – Independent expert on human rights law and policy (Tirana-based). Engaged in research, policy-setting and trainings for/coordinated by several Council of Europe entities; other international and national human rights and rule of law projects.
  • 2016–2017 – Director of Programs, Open Society Foundation For Albania (Tirana). Oversaw, among other matters, the Foundation’s law-related activities, including in relation to the justice reform, human rights protection and litigation, legislative advocacy, establishment of university legal clinics etc.
  • 2015 – Advisor, Special Parliamentary Committee on Justice Reform, Parliament of Albania (Tirana). Advised the Chair of the Special Committee and its secretariat on various substantive matters and coordination of the reform process.
