1. Opening of the 2014 ordinary session

THE PRESIDENT* – I declare open the 2014 ordinary session of the Parliamentary Assembly of the Council of Europe.

      Ladies and gentlemen, I have been a member of the Assembly for 22 years – since the major changes that have swept through Central and Eastern Europe. The Council of Europe is the oldest organisation on the continent and although it has reached the ripe old age of 65, unfortunately, its achievements are not always duly appreciated. We have to work to defend human rights and to develop democracy, as well as co-operation between Parliaments, in order to do our bit to bring about a change in this state of affairs. We do not want this Organisation to become confused with the European Union, or for this Parliamentary Assembly to become confused with the European Parliament.

      I would like you all to accept my very best wishes for the new year. In a few days’ time, we will celebrate the year of the horse – the new year in the Chinese calendar. My best wishes go to current and new members, as well as to parliamentarians from delegations that hold the status of Partner for Democracy, and to all members of the Secretariat.

      In recent months, parliamentary elections held in various member States, ranging from Albania, Germany, Austria, Iceland, Norway and the Czech Republic, have led to changes in certain delegations. Presidential elections in Armenia, Azerbaijan and Georgia were observed by members of the Parliamentary Assembly. Essentially, we are living in very uncertain economic and political times. Dramatic events in Ukraine, which are still under way, only confirm that assertion, but I firmly believe that the Council of Europe will make a significant contribution to preventing any escalation in violence, and to responsible dialogue between the authorities and the opposition in this large European country of almost 50 million inhabitants.

      In October last year, Peter Schieder, from Austria, died at the age of 72 in Vienna. A journalist and film critic, he was soon to become a homo politicus. For more than a quarter of a century, he served as an MP, as a member of the Österreichischen Nationalrat. Peter spent 22 years in our Assembly, including as Chairman of the Socialist Group and President of this Assembly between 2002 and 2005. He was an exceptional individual. I had the honour of participating with him in many international missions. The President of Austria, Heinz Fischer, said of his friend: “Democracy, justice and international co-operation have determined Peter Schieder’s political life.” I ask members to observe a minute’s silence.

      Dear colleagues, European societies and institutions face different challenges today. We should respond to them in close co-operation with the European Union and the Organization for Security and Co-operation in Europe. The good news is that the EU is preparing to sign the European Convention on Human Rights, which entered into force in 1953, creating a common European legal space for over 820 million citizens. Apart from the old problems such as the situation in Belarus or the rights of different minorities – for instance, in some Baltic States – we are facing new ones, linked to the breaches of democratic standards in a more sophisticated way: for example, in Hungary. By and large, one of the most dangerous attitudes in many member countries, including the so-called old democracies such as France, the UK and Greece, is rising nationalism, xenophobia and anti-Semitism, resulting from the decline of democracy and economic crisis. In times of destabilisation and uncertainty, there is a particular need to defend and propagate fundamental values, as well as the ideals of the founding fathers.

2. Examination of credentials

THE PRESIDENT – The first item of business is the examination of members’ credentials.

      The names of the members and substitutes are in Document 13394. If no credentials are contested, the credentials will be ratified.

3. Election of the President of the Assembly

      THE PRESIDENT – We now come to the election of the President of the Assembly.

      Allow me first to express my gratitude to Jean-Claude Mignon for the valuable contribution that he has made to this Assembly as President over the past two years.

      I have received two candidatures with the required support: that of Ms Anne Brasseur, Luxembourg, Alliance of Liberals and Democrats for Europe, and Mr Robert Walter, United Kingdom, European Democrat Group.

      The President is elected by secret ballot, so we need two tellers chosen by lot. The candidate who obtains an absolute majority of the members of the Assembly – 159 votes or more – wins the election. If neither candidate has done so after two ballots, the President will be elected by simple majority of votes cast in a third ballot.

      The arrangements for the election were set out in Document AS/Bur/Inf (2014) 1. I invite the Secretary General of the Assembly to explain the process to members.

      Mr SAWICKI (Secretary General of the Assembly) – The voting process will take place in the central area of the Chamber. Members are requested to queue in the two areas leading to the rostrum for invited guests: one is for members with surnames beginning A to J and the other for Members with surnames beginning K to Z. As you can see, they are clearly marked. In the central area you will find four tables with signature sheets divided into four groups. Representatives with names beginning A to D and E to J are on one side of this area and K to O and P to Z are on the other side. Substitutes who are validated by their national delegation to vote in this sitting must find their name under the surname of the representative for whom they are substituting.

Members will be asked to present their badges and will be given their ballot paper, together with an envelope, once they have signed the signature sheet. Therefore, please have your badge with you. Please be reminded that as this is a secret ballot you are asked to maintain the secrecy of your vote. Several polling booths will shortly be placed here at your disposal. Once you have made your choice, please put your ballot paper in the envelope. You are then invited to cast your ballot in the urn placed next to the rostrum. Please then leave the voting area as soon as possible in order to make room for other members.

Ms Brasseur received 165 votes, which is an absolute majority of the members of the Assembly, and is therefore elected President of the Parliamentary Assembly of the Council of Europe. I invite her to take the Chair.

4. Address by the President of the Parliamentary Assembly of the Council of Europe

      THE PRESIDENT* – I am moved and proud to have been elected President of the Parliamentary Assembly. It is a great honour for the Parliament of Luxembourg, represented here by my national delegation, and I thank them for their unflagging support. First and foremost, I thank the Assembly for the trust it has shown in me and its support. I hope I will show myself to be worthy of it. The election is an honour for democracy and the Assembly, because it was organised perfectly, and I thank the Secretariat for that.

The presence of my friends in the Chamber is a great pleasure for me. I am also grateful to my predecessor, Mr Jean-Claude Mignon. He devoted two years of his life to our Assembly, committing himself fully to our work, defending our values and improving inter-institutional relations. Dear Jean-Claude, I will try to model my term of office on your success, as well as on those of other predecessors. Mr Mignon managed our discussions with charm, flexibility and eloquence. Given that I am not able, like the great majority of us, to express myself in my mother tongue, I will not be able to rise to the oratorical heights of my predecessor. I have chosen to express myself, at least most of the time, in French, which is the language of the Assembly’s host country and one of the two official languages. I may switch to English from time to time.

My country is part of the Francophonie, but our mother tongue is Luxembourgish. Allow me, dear colleagues, to break the rules by saying a few words in Luxembourgish with the agreement of the interpreters, whom I thank.

      Now the Assembly knows what Luxembourgish sounds like, and in English it means:

I am proud, as a representative of the Chamber of Deputies, to take over the presidency of our Assembly, which brings together 318 parliamentarians from 47 European countries, representing 820 million people. I am very much aware of the enormous challenge and great responsibility that that entails, and I thank each and every one of you for your support.

      

I thank the chairpersons of the political groups for their excellent co-operation over recent years in the organisation of our work. It is important for me to express gratitude to the members of my group, the Alliance of Liberals and Democrats for Europe, which I have had the privilege and pleasure of chairing for the past few years, for the good work we have done. Over the past 30 years, only a single member of the Liberal family has presided over the Assembly, so it is with particular emotion that I pay tribute to Lord Russell-Johnston, who was a great President. I also thank my predecessors for their commitment, particularly Leni Fischer, who was the first woman to preside over the Assembly. I am also grateful to the Secretary General of the Parliamentary Assembly, Mr Wojciech Sawicki, and all the members of the Assembly staff for the high quality of their work and their flexibility. I am grateful for their support.

      I ask the Deputy Secretary General of the Council of Europe to pass on this message to the Secretary General: we very much hope to continue to co-operate closely and even better. I am convinced that we will manage to break down the barriers between the different entities of the Council of Europe and strengthen our impact. Obviously, we must co-operate closely with the Committee of Ministers, especially in this period of budgetary cuts, while each body of the Council of Europe preserves its prerogatives. Rest assured that we will continue to follow a policy of dialogue, because that is indispensable to progress.

      The Auschwitz concentration camp was liberated 69 years ago today. On this day of commemoration of the Shoah, we bend before the suffering of all the victims of the atrocities of the Nazi regime. Some 69 years later, we must fight harder than ever to ensure that our objectives and values remain non-negotiable and inalienable. Human rights, democracy and the rule of law must know no borders. We are all here on an equal footing, and there must be no distinction among our countries by size, geographical location or date of membership, or by whether the country in question is a member of the European Union. We must be aware of the extraordinary opportunity for members of this Assembly to meet our counterparts from all countries. Let us benefit from this diversity, and in order that it be a source of enrichment, it is necessary – beyond, of course, permanent dialogue and mutual respect – that we make the effort to understand one another: our past, our history, our culture, our sensitivities and our political opinions. It is our role together to defend – I stress, together – our objectives with determination and commitment not only here in the Assembly by supporting resolutions and recommendations, but in our national Parliaments, where we must be perceived as unconditional defenders of human rights, democracy and the rule of law. We have a very great responsibility indeed.

The challenges awaiting us are enormous, and in the very short time available to me I will not be able to list them all. They range from the rise of extremism and terrorism to trading in human beings, violence against women and children, and the dangers associated with new technologies, to mention but a few. We have a whole toolbox to deal with these challenges. We debate on the basis of public reports, we organise parliamentary campaigns, we participate in the setting of international human rights standards, and we ensure parliamentary involvement in the execution of European Court of Human Rights judgments. We must be able rapidly and effectively to react to crisis situations in our member States, as well as in neighbouring countries. We are all following with a lot of concern and consternation the events unfolding in Ukraine. Violence is never a solution – quite the contrary – and the need to react to this situation is urgent. It is a grave crisis, and I hope that you will support the proposal to hold an urgent procedure debate on this issue during this part-session in order to identify our Assembly’s possible concrete means of action, based on the strict respect of our values and standards.

Another crisis that I cannot fail to mention is the war in Syria and its grave humanitarian consequences. Of course, we are following with some hope – albeit limited – the negotiations in Geneva. I would like to congratulate our rapporteur, Jean-Marie Bockel, on his exceptional work. During this session he will present a report on the situation of Syrian refugees and the organisation of international aid. Finding a political solution to the conflict in Syria will take time, and we must fully support the efforts being made through international diplomacy. At the same time, we must work in our capitals and our Parliaments to propose concrete measures in order to better co-ordinate aid for refugees and assure dignified conditions for them. That is possible, and in this regard I welcome in particular the commitment of our Commissioner for Human Rights.

Dear colleagues, let me now mention five subjects that I think deserve our particular attention, although that does not mean that I am minimising the importance of others. The first is racism, anti-Semitism and lack of respect for others. Migratory flows resulting from the economic and financial crisis are offering extremists fertile ground for the spreading of their ideas, which destabilise our democracies. The second subject, related in part to the first, is co-operation with our neighbours in North Africa, the Middle East and central Asia, where the objective must be to deepen our contacts by developing the status of Partner for Democracy. The third subject is corruption, which is a terrible enemy of our values. It is a scourge that weakens the foundations of our society, and the independence of the judiciary is a precondition to combating it, as is freedom of expression. It is our duty to make sure that these prerequisites are present in our countries, with no restriction whatsoever. The fourth subject is our co-operation with the European Union in order to ensure added value for each of the two partners, and therefore for all our citizens. We will have the opportunity to discuss this with the President of the European Parliament, Martin Schulz, who will address the Assembly on Wednesday. Finally, I would like to stress that we must continue to reform our own procedures, particularly the monitoring procedures, which must be reviewed on the basis of the excellent preparatory work done by the Monitoring Committee.

Ladies and gentlemen, dear colleagues, let us give value to what unites us, and not to what separates us. That is the slogan on the basis of which I would like to work with you. What unites us is the objectives of the Council of Europe: strengthening human rights, democracy and the rule of law through dialogue. We must remind ourselves that our values are not cast in stone – they must be defended day after day. Working together in a spirit of openness and mutual respect is the only guarantee for the stability and security of our continent. Let us work together, therefore, in the spirit of openness and mutual respect, but also taking into consideration what our citizens tell us.

In concluding, I would like to share with you some thoughts of Albert Camus. A democratic regime can be conceived, created and supported only by men and women who know that they do not know everything. A democrat is modest; he admits to a certain degree of ignorance. He recognises that his effort is an adventure and that not everything is God-given, and on that basis he recognises that he needs to consult others and to fill in the gaps in his knowledge with what others know. So let us begin our joint work, our work together, in that state of mind.

Mr WALTER (United Kingdom) – First, I congratulate you, Madam Presiden, wholeheartedly on your success in this democratic election for the presidency of the Parliamentary Assembly. I stood in this election not against Anne Brasseur but to present an alternative view of the future of the Council of Europe and our Parliamentary Assembly. I have worked with Anne Brasseur over many years – in the Committee on Culture, Science and Education, and for the last three years as a fellow head of a political group in the Presidential Committee. I know that she will serve this Assembly well. She will be a good President and she has my wholehearted support for the next year or so during which she holds that office. Anne, congratulations.

THE PRESIDENT – Thank you very much, Bob, for those encouraging words and for your congratulations. I am sure that we will continue to work together in that spirit.

Mr Mignon has asked for the floor.

      Mr MIGNON (France) – Thank you very much, Madam President. It is a great pleasure for me to call you Madam President. I, too, congratulate you most warmly and wish you every possible success. You are taking on the responsibility of President of our Assembly for the next two years. I am convinced that you have the capacity and ability to do this very well and to make it possible for everyone to express themselves and find their proper role within this Assembly. I am sure that you will continue along the same lines as your predecessors – in the plural – because before me there were many others and we are all following a certain logic. Leni Fischer was a female President, and now we have a woman again and that is very positive. On the basis of the experience that I have accumulated over the past two years, I will be available to help – not advise – you whenever you wish: in the shadows, of course, and very modestly. Perhaps I can share some ideas with you. We have already had an opportunity to share ideas in Presidential Committee meetings, so I am certainly at your disposal.

      THE PRESIDENT* – Thank you Jean-Claude. I will continue to take advantage of your very good advice, because I will certainly need it.

5. Election of Vice-Presidents

      THE PRESIDENT* – The next item of business is the election of the Vice-Presidents of the Assembly.

      Nominations have been received for 19 Vice-Presidents. They are listed in an Assembly document number AS/Inf (2014) 03.

      If there is no request for a vote, they will be declared elected.

      Since there has been no request for a vote, I declare these candidates elected as Vice-Presidents of the Assembly, in accordance with Rule 15 of the Rules of Procedure.

      I congratulate the Vice-Presidents who have been elected and who will help me in my difficult work.

6. Appointment of Committees

      THE PRESIDENT* – The next item of business is the appointment of members of committees.

      The candidatures for committee members have been published in document Commissions (2014) 01 and Addendum 1 and Addendum 2.

      These candidatures are submitted to the Assembly for ratification.

      Are these proposals approved?

      The proposed candidatures are approved and the committees are appointed accordingly.

7. Proposals under urgent procedure

      THE PRESIDENT* – Before we examine the draft agenda, the Assembly needs to consider requests for debates under the urgent procedure and on current affairs. The Bureau has received one such request – for a debate under the urgent procedure entitled “The functioning of democratic institutions in Ukraine” from the Monitoring Committee.

      At its meeting this morning the Bureau agreed to propose to the Assembly that it hold an urgent procedure debate on the functioning of democratic institutions in Ukraine, as set out in the draft agenda before you, to take place on Thursday morning at 10 a.m.

      It is proposed by the Bureau that the Monitoring Committee take responsibility for the organisation of the debate.

Does the Assembly agree to these proposals from the Bureau?

They are adopted.

8. Adoption of the agenda

      THE PRESIDENT* – The next item of business is the adoption of the agenda for the first part of the 2014 ordinary session.

      The draft agenda submitted for the Assembly’s approval was brought up to date by the Bureau on 16 December and this morning, and options for responding to the time taken up by my election were provided, in Document 13373 and Addendum.

      As there was one ballot the draft agenda is amended as described in the first scenario

The free debate will be moved to Tuesday at 12 midday because we will not have the time for it today. Is that agreed to? That is the case.

THE PRESIDENT* – I am sorry Mr Gaudi Nagy, but you do not have the right to speak at this point. In accordance with our Rules of Procedure it has been decided not to give you the floor on this occasion. That decision has been taken, so unfortunately I cannot give you the floor, not even for a point of order. I am very sorry, but you do not have the right to take the Floor during these proceedings; the right to speak has been taken away from you. I am sorry, but I have consulted the Secretariat and you do not have the right to speak. Unfortunately, I cannot go back on this decision, which was taken in accordance with our Rules of Procedure. That has been confirmed to me by the Secretary General. I must therefore ask you to sit down; otherwise you will have to be asked to leave the Chamber, which would be most unfortunate. The decision has been taken. I do not have the right to break our own rules and to overturn a decision that has already been taken.
