Strasbourg, 27 June 2003

Dear President,

At the meeting held on 25 June 2003, members of the Committee on Rules of Procedure and Immunities were informed about two practical problems concerning provisions relating to the organisation of Assembly debates.

First, paragraph 2 of the text on "Organisation of debates" (p.88 of the Rules book, 2002 edition) says that for debates on the morning of the second day of a part-session, amendments should not be tabled later than 4 p.m. on the first day. This limitation to the morning sitting penalises the afternoon sitting, as amendments for its debates would have to be tabled already at 3 p.m. on the first day. Consequently, the Committee on Rules of Procedure and Immunities proposes to delete the words "the morning of".

Secondly, the Committee noted the difficulties of the practical application of paragraph 11 of the text on "Order of speakers" (p.96 of the Rules book, 2002 edition) which stipulates that "If a speaker whose name is on the list is prevented from taking the floor during the debate, and he/she has notified the Chair before he/she has been called, the next speaker of the same Group will be moved up in his/her place". To make this passage more precise, my Committee proposes that the words “next speaker of…" be replaced by “first on the list of subsequent speakers from…”.

As the afore-mentioned texts were adopted by the Bureau of the Assembly, with the approval of the Standing Committee, I should be most grateful if the Bureau could take a decision at one of its next meetings on the changes proposed by the Committee on Rules of Procedure and Immunities.

3. Seeking to foreclose any eventual attempts by authorities of a State observed to play one parliamentary institution against the other;

4. Determined to streamline and harmonise their interaction in election observation have agreed on the following:

i. Whenever a parliamentary institution decides to observe an election it shall inform, through a letter from its Secretary General to his counterparts, its two parliamentary partners of the decision.

ii. Should it so happen that the three institutions concerned all take a decision on observing a given election, their delegations shall then constitute a Parliamentary Troika. Whenever the OSCE Office for Democratic Institutions and Human Rights (ODIHR) is also observing the same election, the Troika, together with the ODIHR, shall act as part of an International Election Observation Mission (IECOM). Enlargement of IECOM to other institutions, should be submitted to the previous agreement of the three assemblies and ODIHR.

iii. A standard joint programme of activities shall be established for the Parliamentary Troika. It shall include meetings with top political leaders of the country whose elections are to be observed, with the Chair of its Central Electoral Committee or similar body, with the Chair of the Court dealing with election-related complaints and appeals, with the media and NGO community, with resident ambassadors of the countries represented on the Parliamentary Troika. Parliamentary institutions delegations, where appropriate, may also chose to have individual supplementary meetings;

iv. No member of the Parliamentary Troika shall seek the role of lead institution; Chairmanship of Parliamentary Troika meetings during an election observation shall be rotating, its order to be decided upon on a case-by-case basis;

v. Leaders and rapporteurs, when appropriate, of the Parliamentary Troika delegations, and -senior staff member and ODIHR representatives, shall meet during the election observation to coordinate their activities.

vi. A final press statement, bearing the logos of the three parliamentary institutions and the OSCE ODIHR shall be prepared jointly on behalf of the International Election Observation mission. It shall then be presented jointly by the leadership of the International Election Observation Mission at a press conference co-chaired by the leaders of the three parliamentary delegations. The press conference shall be preceded by a parliamentary debriefing where parliamentary observers shall coordinate their findings. Parliamentary Troika, following internal consultations, may decide to invite ODIHR representatives to such debriefings;

vii. In order not to prejudice the findings of the International Election Observation Mission, the Parliamentary Troika members shall respect media silence procedure in force until the end of the joint press conference held the day following the elections and shall refrain from making statements to the press relating to the election in question until after the press conference.

APPENDIX 3

Pre-electoral mission to Baku (Azerbaijan) 15-16 September 2003

Memorandum submitted by Mr Andreas Gross (Switzerland, Socialist Group), Leader of the Assembly’s delegation

1. Pursuant to a Bureau decision, a five-member delegation (see Appendix 1) carried out a pre-election mission to Baku on 15 and 16 September 2003 to assess the overall political climate in that country ahead of the 15 October presidential election.

2. The Delegation had an intensive programme of meetings (Appendix 2) that included discussions with Presidential candidates, Head of the Central Electoral Commission, Presidents of the Constitutional Court and The Court of Appeals, Head of Presidential Administration, and a representative cross-section of NGOs and the media, as well as the OSCE/ODIHR election observation mission.

3. In a welcome development, ahead of the delegation’s visit, the authorities of Azerbaijan amended the electoral law to accommodate some important recommendations by the Venice Commission and the OSCE/ODIHR. While the Law could still be significantly improved further, even as it stands now, it could provide, in principle, a satisfactory framework for good elections if applied in good faith. It is thus essential for the PACE ad hoc committee to observe how accurately the new provisions are applied by the election administration during the forthcoming election.

4. The delegation was told by the official interlocutors that, according to some independent opinion polls, if the elections were conducted earlier in the year, the incumbent President would have won by a wide margin, a statement that looks credible. In that situation, the authorities would feel inclined to have an election that is deemed acceptable by all concerned.

5. However, health problems of the incumbent have created an all-new situation. President Aliyev’s long absence from Azerbaijan, from public life and view has left the country in a deep uncertainty leading to all sorts of rumours and anxieties. This unfortunate situation of a political limbo with electorate not knowing who is actually running for the top job puts into question the very possibility of having a good election.

6. A more general question arises as to who is running the country, considering that the incumbent President is away, and the newly appointed Prime Minister, Mr Ilham Aliyev, President Aliyev’s son, who is also a candidate, had to step down to comply with the existing legislation, and the previous Prime Minister is acting as the head of the Cabinet.

7. The composition of the Central Electoral Commission with the majority of its members belonging to the ruling party or its supporters is yet another source of grave concern. It undermines the credibility of the democratic process and deepens the already profound mistrust of the electorate in its fairness. Furthermore, instead of being a consensus based technical body, as its role is defined by the legislation, the Commission has turned into a virtual political battlefield where decisions are taken by simple majority.

8. The Commission is yet to fulfil the legal requirements of making voter registers public early on. This situation leaves little time to take corrective action for those concerned.

9. In the interests of transparency, voter confidence building and with a view to minimising any possibility of fraud or vote rigging the delegation has requested that the CEC make the results of the vote count public immediately, once the count is over, and not within 48 hours as is currently foreseen.

10. What was particularly worrying to the delegation was heavy media bias in favour of the incumbent and his supporters. Furthermore, campaign materials of the President and Mr Ilham Aliyev were omnipresent. The delegation was informed that shop owners, taxi and bus drivers were put under pressure and intimidation to display the campaign materials of the incumbent’s camp. While in no position to disprove or confirm this, the delegation was concerned that the overall atmosphere was not that of a fair and equitable contest for all of the candidates. This requires immediate attention of the authorities, since if the opposition feels it has no constitutional ways of influencing the process it could create an explosive political situation.

11. Finally, the opposition, too, bears its share of responsibility for the prevailing climate of overall political mistrust in the country. Instead of engaging in a meaningful political debate on the future of Azerbaijan and proposing specific projects aimed at a democratic development of the country, the disunited opposition is involved in petty politicking, not caring to offer a viable alternative to the forces in power they oppose. As a result, personal rivalries and animosities replace debate on the basis of solid programmes or platforms. If the opposition has constructive and democratic goals other than just ousting the incumbent and his supporters it should rather spell those goals out in the little time left before the election.

12. In my capacity as co-rapporteur of the Monitoring Committee and as part of a follow-up to the monitoring visit in July, I spent two additional days in Azerbaijan after the departure of the delegation. I made a repeat visit to the regions of Kazak and Gangia (500 km north-west of Baku). Concerns of the electorate there with regard to the prospects for a good election were far more pronounced than in the capital. I have received many accounts of people feeling totally under pressure and police cracking down heavily on any expression of opposition – be it campaign materials or individuals. Such regrettable and worrisome environment does not bode well for the 15 October election.

13. When the ad hoc committee is in Azerbaijan for the elections it should follow up with the Azerbaijani interlocutors on the findings and recommendations of the pre-electoral mission. Without prejudging the conclusions of the ad hoc committee, the upcoming elections would be the litmus test of Azerbaijan’s preparedness to have a democratic succession or transfer of power.

Statement of the Council of Europe Parliamentary Assembly’s ‘pre-election’ delegation to Azerbaijan

Baku, 16 September 2003

A five-member pre-election delegation4 of the Parliamentary Assembly of the Council of Europe, representing all political groups of the Assembly, visited Azerbaijan on 15 and 16 September 2003 to assess the overall political climate in the country ahead of the 15 October presidential election.

The delegation met, inter alia, with presidential candidates, the head of the Central Election Commission, the head of the Presidential Administration, the Presidents of the Constitutional and Appeal Courts, a cross-section of national and international NGOs and the media.

Based on discussions it had, the delegation analysed the situation and came to the following conclusions:

The delegation welcomes the arrangements made by the Azerbaijan authorities, long in advance of the vote, to ensure that the 15 October election is conducted in an acceptable manner. The amended Electoral Law accommodated several recommendations of the Council of Europe and, while not yet perfect, would provide a satisfactory framework for good elections if applied in good faith.

However, the health problems of the incumbent President and the main candidate of the ruling party, Haidar Aliyev, who has been absent from Azerbaijan and out of public view since 8 July, have left the nation in a deep state of uncertainty and a precarious situation ahead of the election. Ilham Aliyev, the son of the incumbent President, also a candidate, was appointed Prime Minister but had to step down to comply with the requirements of the existing legislation. There is a need for clarification if a real election is to be held.

The composition of the Central Election Commission, the majority of whose members belong to the ruling party or its supporters, is a source of major concern. The delegation expects the Central Election Commission to take urgent steps to meet the requirements of the Electoral Law, which defines the Central Election Commission as a consensus-based technical body for administering elections.

The delegation asks the Commission to make sure, for example, that registers of voters are published well ahead of the vote, making it possible for those concerned to take corrective action if necessary. Furthermore, the delegation feels very strongly that the results of the vote count should be made public immediately, once available, and not after 48 hours as currently foreseen.

The delegation voiced its concern about a heavy media bias in favour of the incumbent President and his supporters, as well as the omnipresence of their campaigning material throughout the country. A further source of concern were the complaints of many supporters of the opposition and NGOs who feel harassed and intimidated, as well as the prevailing climate of overall political mistrust in civil society that has created a tense, if not explosive political situation.

The delegation notes with regret that there is no meaningful debate on projects and programmes for the country, which has led to a situation where personal rivalries and animosities have replaced substantive campaigning.

The delegation insists that fair and equitable conditions for all candidates be created without further delay if the opposition is to have a democratic alternative to make its demands heeded.

Fortunately four weeks still remain for the authorities to meet the conditions indispensable for the good conduct of this election, which is crucial for the democratic future of Azerbaijan.

The delegation calls on them to take the urgent measures suggested to official interlocutors to ensure that the 15 October election is held in full compliance with the commitments Azerbaijan subscribed to upon joining the Council of Europe.
