This motion has not been discussed in the Assembly and commits only the members

1.         Taking into
  account the permanently increasing over the last years number of working
  migrants of the Central and East European origin employed on the temporary
  basis all around the EU-member states and Council of Europe member states as
  well as those looking for employment, the following issues emerged:

Necessity of
  changes to be made to the national legislatures of the countries-donators of
  the labour force in spheres regarding activities of the recruiting companies;

Insufficient
  legal grounds of bilateral international agreements between
  countries-recipients and countries-donators of the labour force;

Number of Central and
  Eastern European countries have not implemented the European Convention on
  migrant workers (1977) that leads to the legal and social vulnerability and
  violation of their citizens rights while abroad;

The situation with illegal
  migrants in the Council of Europe member states has appeared to be alarming.

2.         The European
  Convention includes legal provisions on the following matters concerning
  migrant workers: social and medical insurance, social security, taxation,
  pensions, accommodation, education, etc. All these provisions can be referred
  to as ones in the sphere of public law. But migrant workers come across a
  number of the problems in the sphere of private law. Such issues partially
  should be solved in the national legislation and partially in the
  international agreements, e.g. recruitment for the third country, legal status
  of recruiting entity in the state of employment.

3.         The Assembly
  considers it necessary to examine the problem in order to propose concrete
  measures to be taken in order to improve the situation of the people belonging
  to the category of migrant workers.
