The oil tanker “Prestige” was shipwrecked in November 2002, off the Atlantic coast of Spain. Its captain, Mr Apostolos Mangouras, has been successively put in jail and under house arrest, awaiting trial. More than fourteen months have already passed and no date has been fixed for his case to be brought before the court.
The Parliamentary Assembly of the Council of Europe,

Having regard to the written statement of Captain Apostolos Mangouras, Master of the “Prestige”, to the European Parliament (public hearing of 19 and 20 March 2003);

Being concerned at the increasing criminalisation of seafarers and the damage done thereby to the image of a seafaring career;

Regretting the fact that Captain Mangouras has been treated as a criminal though he is not responsible for the damage sustained by his vessel;

Supporting all European and international decisions on the issues of maritime security, protection of the environment and compensation of those affected by accidents at sea;
Calls on the Spanish judicial authorities to lift the conditions under which the captain of the “Prestige” has been placed under house arrest, as stated in the relevant Resolution of the European Parliament/Committee on the safety at sea (2003/2066/(INI)), and allow his free movement within the single European territory.
