The agreement concluded on 28 May between the European Union and the United States will oblige all passengers boarding a transatlantic flight to the United States or Canada to give their consent for their personal details to be passed on to the American authorities.
There were considerable reservations about this agreement in Europe, within both the European Commission and the European Parliament.
Moreover, during the negotiations, most national authorities responsible for the protection of freedoms voiced their fears about the plan.
The Parliamentary Assembly of the Council of Europe is duty bound to express its concern about the above agreement:
first, because of the approach adopted by the United States, which was to impose measures under threat of heavy economic sanctions
second, because of the consequences of this agreement, whose compatibility with the European Convention on Human Rights with regard to the protection of personal data is at the very least debatable. The few guarantees obtained are by and large dependent on American good will and are not enough to ensure that the information collected will remain confidential and be used appropriately.
We would like the Assembly to look at the compatibility of this agreement with the standards set out by the Council of Europe regarding the fight against terrorism.
