Withdrawal of military forces of the Russian Federation from the Eastern districts (Transnistria) of the Republic of Moldova

Motion for a resolution
 presented by Mr Ilascu and others

This motion has not been discussed in the Assembly and commits only the members who have signed it

1.                  In 1992, the Russian military forces conducted a military aggression against the newly created state of the Republic of Moldova and its eastern territories were taken over.

2.                  On 8 July 2004, the Grand Chamber of the European Court of Human Rights  ruled in the case of “Ilascu and others vs. Moldova and Russia”, with regard to the events that took place in Transnistria (Republic of Moldova) between 1991 – 1992.

3.                  With regard to the Russian Federation, the Court ruled: “During the conflict in the Republic of Moldova on 1991 – 1992, forces of the 14th Army stationed in Transnistria (belonging successively to the USSR, the CIS and Russia) fought with and for the Transnistrian separatist forces. Important amounts of weapons from the arsenal of the 14th Army were deliberately transferred to the separatists who, moreover, were able to get other weapons without any obstacle from the Russian soldiers. Thus, the Russian authorities have contributed both military and politically to the creation of a separatist regime in the region of Transnistria who is part of the territory of the Republic of Moldova”.

4.                  In the moment, the Russian army of occupation continues to stay illegally on the territory of the Republic of Moldova against its will.

5.                  The Russian Federation continues to violate its own obligation to completely withdraw its army from Moldova, obligation assumed on the occasion of the OSCE Summits in Istanbul (1999) and Porto (2001).

6.                  Taking all this into consideration and the critical situation created in the region, the Assembly calls on the Russian Federation:

-                       to immediately and unconditionally withdraw the military forces illegally stationed on the territory of the Republic of Moldova, according to its engagements taken on the occasion of the OSCE Summits in Istanbul and Porto;

-                       to recover the entire military arsenal that was deliberately transferred to paramilitary units of the separatist regime from Tiraspol and to evacuate it to its territory;

-                       to cease to provide political, diplomatic, economic and military help for the separatist regime in Tiraspol (Transnistria).
