Liberation of political prisoners from Tiraspol – Andrei Ivantoc and Tudor Petrov-Popa

Motion for a resolution
 presented by Mr Ilascu and others

This motion has not been discussed in the Assembly and commits only the members who have signed it

1.       In 1992, the military forces of the Russian Federation, together of the paramilitary units of the separatist regime in Tiraspol, conducted a military aggression against the recently created state of the Republic of Moldova, taking over a part of its Eastern territory.

2.       During the Moldovan-Russian war in 1992, the special forces of the 14th Army, in co-operation with the Russian mercenaries, arrested, in Tiraspol, many political leaders of the Popular Front from Moldova, members of the only opposition party in the region.

3.       Currently, there are only two political prisoners left from those arrested 12 years ago by the Russian intelligence service and they are still illegally detained: Andrei IVANTOC and Tudor PETROV-POPA.

4.       On 8 July 2004, the Grand Chamber of the European Court of Human Rights ruled on the case of “Ilascu and others vs. Moldova and Russia” and asked for the immediate and unconditioned release of the two political prisoners Andrei IVANTOC and Tudor PETROV-POPA.

5.       Instead of implementing the Court decision, both the State Duma and the Ministry of the Russian Federation each adopted an insulting official Declaration toward the ECHR, blaming it for “political partisanship and engagement”, “using double standards in the European jurisprudence”, “supporting the terrorism” and other serious accusations.

6.       Taking into account these serious facts, the Assembly calls on:

          - the Russian Federation:

- to immediately and unconditionally release the political prisoners from Tiraspol – Andrei IVANTOC and Tudor PETROV-POPA according to the ECHR’s decision;

- to stop denigrating the ECHR and to fully implement its decision in the case of the “Ilascu group”;

          - the Committee of Ministers:

- to monitor and decide on the respect, by the Russian Federation, of the decision of the Grand Chamber of the ECHR in the case “Ilascu and others vs. Moldova and Russia”.
