Legal, political and historical responsibility of Armenia which has perpetrated crimes against humanity

Written question No 498 to the Committee of Ministers
presented by Rafael Huseynov


Armenia, which has conducted systematically the policy of genocide and terror against the Azerbaijani people through all decades of the 20th century, murdered totally about 1 million people by the most brutal methods within that period. Such kind of acts of genocide, accompanied with the most terrible forms of torture and terror aimed at the extermination of the Azerbaijani people, are being continued even today by Armenia, which carries out biological and ecological terror, creates nuclear waste cemeteries in the occupied territories. There is a lot of material evidence, written documents, photos, chronicles, evidential testimonies etc. undeniably proving and disclosing the actions of Armenia undertaken in the years of 1905, 1918, 1920, 1930-1937, 1988-1992 accompanied by mass massacres aimed at exterminating Azerbaijanis as a nation. All of this should be considered as the gravest crimes against humanity. The actions like putting people into the mosques and other closed buildings and burning them alive, killing pregnant women together with their unborn children by ripping their abdomens, killing children by torture before their parents′ eyes, killing people by putting them into concrete tubes and shutting them up in the tubes from both sides, murdering the elderly men and women by pulling out their eyes and cutting off their different organs and similar range of terrors are virtually the crimes perpetrated by Armenia not only against Azerbaijanis, but also against mankind as a whole and all of these should by all means be investigated and punished in compliance with the norms of international law.

On February 26 1992 the armed forces of Armenia within one night devastated the city of Khojali with the population consisting mostly of elderly men and women, children, killed hundreds of people with special mercilessness keeping in the shadow even the murders executed with the most sadist methods in the fascist concentration camps. There is a large number of available documents and evidence related to the large-scaled criminal acts perpetrated by Armenia against humanity during the Khojali genocide, which is one of the biggest tragedies of the modern world. Due to the fact that Armenia has not been subjected to any punishment in spite of its criminal actions, it continuously increases the scope and diversity of its criminal activities, even today it continues its aggressive policy, abets terrorism at the state level and provides safe heavens for terrorists training camps in the occupied territories of Azerbaijan, gets engaged in drug cultivation and drug trafficking. Therefore, as the international organizations, in which Armenia enjoys membership, do not give the political and legal assessment of the criminal actions of Armenia against humanity, these actions in essence define responsibility for these institutions as well.

Considering all of these, Rafael Huseynov asks the Committee of the Ministers:

What debates can the Committee of Ministers conduct in order to give the political and legal assessment of the actions of Armenia, which during the past 100 years has been conducting the policy of genocide accompanied by mass massacres aimed at exterminating consecutively and systematically the people of Azerbaijan and thus committing the most serious bloody crimes against humanity; What guarantees can the Committee of Ministers give in order to consider this case in the European Court of Human Rights;

And finally what concrete and resolute steps can the Committee of the Ministers take within its competence in order to suspend the membership of this aggressive state, the deeds of which are not in concordance with the principles of the Council of Europe?
