Amendment No. 5 | Doc. 14835 | 11 April 2019
Anonymous donation of sperm and oocytes: balancing the rights of parents, donors and children
Committee on Social Affairs, Health and Sustainable Development
In the draft recommendation, paragraph 2, replace the first sentence with the following sentence:
"There has been movement towards recognition of a right to know one’s origins in the last decades, connected to the right to an identity and to personal development: In international human rights law, through its inclusion in the United Nations Convention on the Rights of the Child as a "stand-alone" right for children, and in European human rights law through the case-law of the European Court of Human Rights, which has recognised this right as an integral part of the right to respect for private life.".
Explanatory note
This amendment clarifies the original wording and thus addresses the concerns raised in amendments 1 and 2 tabled by the Committee on Legal and Affairs and Human Rights (which thus become moot).
