Summary

      Every year the Assembly is required to present an opinion to the Committee of Ministers assessing political aspects of the Council of Europe budget as a whole. The Assembly makes general recommendations on the Council's functioning on the basis of:

i.       the most recent accounts approved by the Board of Auditors (1991 financial year);

ii.       the budget for the current year (1993);

iii. the budget forecasts for the following year (1994).

      The Assembly found the 1991 accounts to be correct and in order and stated that the Council's financial management had been conducted with a commendable sense of economy.

      It notes from the 1993 budget that budget growth is continuing, making it possible to adapt the Council of Europe's structures and activities to the new tasks arising from opening up to central and eastern Europe.

      As regards the 1994 budget the Assembly takes the view that the Council of Europe must be enabled to rise to its new challenges (enlargement and follow-up to the summit meeting of heads of state and government) and requests the necessary financial and manpower resources.

      I.  Draft opinion

1. The 1994 Council of Europe budget is being prepared in the context of the further enlargement of the Organisation to include central and eastern European countries (Lithuania, Slovenia and Estonia joined in May 1993 and other states, in particular the Czech and Slovak Republics, will probably become members in the course of 1993).

2. The budget is also being prepared with a view to the Summit of Heads of State and Government of the Council of Europe member states (Vienna, 8 and 9 October 1993), which could take decisions that have budget implications for the Organisation.

3. The Secretary General, in her proposals, the Assembly, in its requests (opinion on the programme-budget for the operational expenditure of the Assembly in 1994), and the Committee of Ministers, in its budget decisions, must all take these changes into account.

4.       Consequently,

A. With regard to the Council of Europe general accounts for 1991, the Assembly:

a.       is satisfied with the opinion of the Board of Auditors, which certified that the general accounts were accurate and in keeping with the rules, and which stated, in particular, that the budgetary expenditure was in keeping with the purpose and limits of the appropriations, and that the financial management had been conducted with a commendable sense of economy;

b.       supports the recommendations of the Board of Auditors and the Secretary General's intentions with regard to the modernisation of financial and staff management and stronger financial control and hopes that appropriate financial resources will be placed at the Secretary General's disposal;

c. expresses concern about the delays in the payment of contributions by certain member states, which may go so far as to cause the Organisation cash flow problems, and endorses the Secretary General's invitation to member states to abide by the time-limits provided for in the Financial Regulations.

B. With regard to the 1993 budget, the Assembly:

a.       is satisfied with the continued real growth of the budgetary resources made available to the Council of Europe (7,57% for the ordinary budget in 1993). For the first time, the total of the Organisation's budgets, including partial agreements, has reached 1 thousand million French francs;

b.       is aware of the difficult economic climate and the budgetary restrictions with which member states have to contend, but regrets the fact that the Organisation's budget has not increased as much as in previous years (9,57% in 1992, 11,45% in 1991, after several years' stagnation), even though increasing demands are placed on it, particularly as a result of the new tasks entailed by the Council's opening its doors to central and eastern Europe;

c. welcomes, in particular, the increase in the staff of the Secretariat, in which the number of permanent jobs, although still insufficient, continued to increase, reaching a total of 1 096 (1 016 in 1992).

C. With regard to its own budget for 1993, the Assembly:

a.       observes with satisfaction that the increase in Vote III in real terms (7,65%) is not only greater than the increase in 1992 (5,35%) but that, in contrast to last year, it matches the increase in the ordinary budget;

b.       also observes that there has been a slight improvement in the budgetary position in respect of Vote III which, in 1993, accounts for 8,11% of the sum total of the appropriations, although it still lags behind both the Court and Commission of Human Rights and the Intergovernmental Programme of Activities;

c. regrets that its requests for staff have been only partially met, with the result that it is unable to use the resources at its disposal as effectively as possible and to organise the Secretariat of the Clerk's Office in such a way as to meet its new needs.

D. With regard to the budget prospects for 1994, the Assembly:

a.       hopes that the timetable for the new budget procedure laid down by the Committee of Ministers at its 472nd meeting, in March 1992, will be observed, so that it can, in particular, draw up its budget proposals in the light of information provided by the Ministers' Deputies;

b.       considers it necessary to continue to increase the budget so as to reach a minimum threshold that will enable the Organisation to meet the new challenges facing it: the enlargement of the Council of Europe, co-operation with the central and eastern European countries, inappropriate human resources and infrastructure, possible extension of the areas of responsibility of the Organisation;

c.       recommends that consideration be given, where applicable, to the provision of additional financial resources for certain programmes and activities, such as co-operation with other organisations, contributions from ministries other than foreign affairs ministries and the establishment of foundations;

d.       considers it politically essential to continue, and even to step up, the assistance provided to the new democracies so as to provide as much encouragement as possible for the changes taking place;

e.       considers that there is an urgent need to adapt the size of the Secretariat staff to the Organisation's increased workload, especially in view of the enlargement of the Organisation and the resulting new activities;

f.       requests that further efforts be made to provide the Secretariat with the practical resources it needs, in particular offices and computers;

g.       reiterates its requests to the effect that staff management be modernised and social achievements (training, equality between the sexes, legal protection, right of negotiation, etc) be consolidated and extended;

h. hopes that an information policy in keeping with the aims and new role of the Council of Europe will be adopted at last and implemented with the active co-operation of the member states.

      Lastly there were two accounts governed by special rules:

      —th e Partial Agreement Establishing the European Centre for Global Interdependence and Solidarity, which had a budget of 4 000 000 francs and a credit balance of 8 351,81 francs;—

      —th e Partial Agreement on the European Support Fund for the Coproduction and Distribution of Creative Cinematographic and Audiovisual Works (Eurimages), which had a budget of 159 161 722,76 francs and a credit balance of 78 509 750,55 francs.b.

b. Report of the Board of Auditors (CVC) and the Secretary General's comments on the report

      These two documents deal with various matters, some of which may be summarised here:

      i.       Accounting system

      The CVC draws attention to its previous recommendations on improving and simplifying the Council of Europe's accounting procedures. One of the recommendations was that a system of analytical accounting be introduced.

      The Secretary General points out that, with a view to modernising the management system, the Director of Administration has appointed a committee to draw up specifications for the new system.

      ii.       Personnel management

      The CVC likewise stresses the need to modernise staff management and the importance of making available the necessary resources. A consultant has produced two reports, on the scope of personnel management within the Council of Europe and the aims and objectives of Personnel Division and on a computerised personnel records system. The Secretary General has asked for more resources to be allocated to this area.

      iii.       Computer security

      The CVC draws attention to its recommendations concerning security risks resulting from shortage of staff and expresses the hope that additional protection measures will be taken.

      While regarding security matters as a priority, the Secretary General believes that the Council of Europe computer network is now highly secure but that the necessary investment in security and a shortage of staff are slowing down the development of some applications.

      iv.       Internal control

      The CVC concludes there is a need for clearer guidelines on financial control and recommends assigning more staff to the Financial Controller's office in view of the heavier workload (checking of staff remuneration, inventory control, supervision of computerised management systems, etc.).

      The Secretary General agrees with those findings and will act on them.

      v. Delay to contributions and other incomings

      The CVC notes that delays in the payment of some member states' contributions have been lengthening in recent years, causing the Council some solvency problems. In 1991 the total amount of delayed payments (35 400 000 francs) far exceeded the amount in the Working Capital Fund (19 900 000 francs).

      The Secretary General shares the CVC's concern and asks member states to comply with the deadlines laid down in the Financial Regulations. In addition, she points out the possible inadequacy of the sum in the Working Capital Fund, which now represents less than 2,5% of the total of the various budgets.

      Lastly, the CVC suggests improvements, with which the Secretary General agrees, to management of resources allocated to the Partial Agreement on the Prevention of, Protection Against, and Organisation of Relief in Major Natural and Technological Disasters and the European Centre on Global Interdependence and Solidarity. There are no observations concerning the Partial Agreement on the European Support Fund for the Coproduction and Distribution of Creative Cinematographic Audiovisual works (Eurimages).

      Apart from minor considerations, the CVC has no comment on the accounts of the Cultural Fund, the Sports Fund and the European Youth Foundation.

C.       1993 Budget

      The 1993 ordinary budget as adopted by the Committee of Ministers (Resolution (92) 45) comes to 743 867 000 francs, an increase of 72 284 000 francs (10,76%) on 1991, 33 451 000 francs (4,98%) of it in real terms.

      The Committee of Ministers also approved additional expenditure totalling 17 360 000 francs in 1993 (8 000 000 francs on capital investment and 9 360 000 francs on co-operation with central and eastern Europe), financed by the balance of the 1991 budget.

      Resources available under the 1993 ordinary budget thus total 761 227 000 francs, an increase of 89 644 000 francs (13,35%) on 1992, including an increase in real terms of 50 811 000 francs (7,57%).

      The increase is somewhat smaller than the 1992 increase (9,57%) but must be viewed positively when set against the extremely difficult financial circumstances with which governments of a number of member states are having to contend.

      The following comparative tables are appended to this report:

—       Appendix I — Table 1

Budget figures for the last five financial years showing trends in appropriations, in francs;

      The partial-agreement budgets, compared with 1992, will be found in Appendix IV, Table 4.

      At 743 million francs the ordinary budget the Committee of Ministers has voted for 1993 confirms the growth over the last three financial years. When the subsidiary budgets and partial-agreement budgets are included, in 1993 the Council of Europe's funds exceed one billion francs for the first time.

      On closer inspection, of the real-term increases under the various votes in the ordinary budget the following are of particular note:

      —Vo te IX (Co-operation with central and eastern Europe): 16,21%, to which should be added 9 360 000 francs in additional expenditure financed by the balance of the 1991 general budget (9 193 000 francs) and a voluntary contribution from Switzerland (167 000 francs), bringing the increase to around 46%;—

      —Vo te V (Standing Conference of Local and Regional Authorities of Europe): 15,72%;—

      —Vo te VIII (Investment expenditure): - 15%, though to that must be added 8 000 000 francs in additional expenditure financed by the balance of the 1991 general budget, resulting in an actual increase of 25%;—

      —Vo te II (Intergovernmental programme of activities): only 0,11%, though in actual fact the allocation of appropriations results in a clear increase of 3,37% in respect of activities;—

      —Vo te VII (European Youth Foundation): the setting up of a Youth Directorate has involved transferring European Youth Foundation appropriations which hitherto appeared separately under Vote VII to various sub-heads in Vote I and Vote II. The appropriations have thus been reallocated in 1993 and the separate vote has been done away with.In

      In terms of percentage share of total appropriations, Vote I (Common expenditure: staff, supplies, publications, information etc.) comes to 57,20% of the budget. Next come Vote IV (Court and Commission of Human Rights) with 13,57% of the budget, Vote II (Intergovernmental programme of activities) with 10,82%, and Vote III (Parliamentary Assembly) with 8,11% (as against 7,81% in 1992). This does not take into account the 3 010 000 francs allocated to the Assembly under Vote IX for interparliamentary co-operation.

      As regards the Assembly, the increase in appropriations is 7,65% (Vote III only) on 1992 as compared with a 7,57% increase in the ordinary budget as a whole, whereas in 1992 the increase in the Assembly's budget was much lower. Also noteworthy is the 105% increase for the interparliamentary co-operation programme (Vote IX), the appropriations totalling 3 010 000 francs as against 1 469 000 francs in 1992.

      The Committee of Ministers has acceded only in part to the Assembly's staff requests, which it has divided into two groups. The first group of posts (a new A5 post, two new A2/A3 posts and a new B3 post) will be filled at around 1 August (to take an average date). In the case of the second group of posts (a new A4 post, a new A2/A3 post and two new B3 posts) the Committee of Ministers expressed understanding of the Assembly needs unmet by the 1993 budget and decided to consider the matter further at the start of preparation of the 1994 draft budget. The Assembly will have to try to ensure the posts are filled as from 1 January 1994.

      As regards the various sections of Vote III (Parliamentary Assembly expenditure), the increase in appropriations granted by the Committee of Ministers in real terms is lower than the Assembly requested. This applies particularly to the total package (an increase of 2 000 000 francs as against the requested increase of 4 000 000 francs). It does not apply, however, to the allocation to the Assembly's political groups, the 500 000 francs requested increase for which was granted.

D.       1994 Budget

      The 1994 budget, like the previous budgets, is being prepared in the context of political change in Europe, marked by the democratisation of the countries of central and eastern Europe and their increasingly close relations with the Council of Europe. Relations with the countries of central and eastern Europe are still one of the priorities of the Committee of Ministers and the Parliamentary Assembly.

      There will be changes in the membership of the Council of Europe in 1993, which will necessarily have implications for both the budget and the activities of the Organisation. The year began, on 1 January, with the dissolution of the former Czech and Slovak Federal Republic. Its disappearance as a state brought the number of member states to twenty-six.

      Now that the Assembly has expressed a favourable opinion, Estonia, Lithuania and Slovenia will be invited by the Committee of Ministers to join the Council of Europe on 14 May 1993. The Czech and Slovak Republics should also become members of the Council of Europe in the near future.

      The membership applications of other states have also been submitted to the Assembly for an opinion. In the case of certain states which already enjoy special guest status, the Assembly has already appointed rapporteurs to examine the applications (Albania, Croatia, Latvia, Romania, Russia, Ukraine). In the case of Belarus, the membership application has been transmitted to the Assembly for an opinion. Moreover, Moldova has obtained special guest status, which has also been requested by several other countries.

      It will be remembered in this connection that Mr Tarschys and others tabled a motion for a recommendation on the establishment of a solidarity fund for new democracies that were members or special guests of the Council of Europe. This proposal might be submitted to the Committee on the Budget and the Intergovernmental Work Programme in the context of Sir Keith Speed's report on the enlargement of the Council of Europe and budgetary prospects.

      This year the Council of Europe is also faced with a major event, of which the results are yet another unknown quantity: the Summit of Heads of State and Government of the member states, which is to take place in Vienna on 8 and 9 October 1993. The summit could well take various decisions which would have important implications for the Organisation. Examples are changes in the areas of responsibility of the Council of Europe, in the rate at which the Organisation is expanding, and in certain structures.

      In any event, it is already clear that the current enlargement is bound to continue, and this will have implications for intergovernmental and parliamentary co-operation with the new member states and the applicant countries (adaptation of structures, increased Secretariat staff, increased resources), though this ought not to undermine the Organisation's traditional activities.

      That is why the existing co-operation programmes will have to be maintained, if not stepped up, given the growing number of countries benefiting from them and the increase in the number of co-operation fields. The "Demosthenes" and "Demosthenes bis" programmes (the latter intended for the republics of the former Soviet Union) for Council of Europe co-operation and assistance with a view to the promotion of pluralist democracy, human rights and the rule of law, and such special programmes as Themis (legal co-operation) and Lode (local democracy) will need increased resources in 1994. The same is true of the Assembly's interparliamentary co-operation programme. Vote IX of the budget, which covers these activities, should receive priority attention and increased appropriations.

      The Organisation's other sectors and fields of activities should not, however, be forgotten, since the Council of Europe must be able to pursue its work programme and involve a larger number of member States, which will entail an increase in costs, whether in the case of intergovernmental activities (Vote II), the Parliamentary Assembly (Vote III), the Court and Commission of Human Rights (Vote IV) or the Standing Conference of Local and Regional Authorities of Europe (Vote V).

      Consideration must also be given to the logistic resources needed to match this increased workload, for both shared expenditure, particularly on staff (Vote I) and expenditure incurred by investment in new offices (Vote VIII).

      These considerations will doubtless raise the general issue of the financing of the Council of Europe, especially at a time when a fair number of member states are experiencing budget difficulties. It will be necessary here to ascertain their political will with regard to the role which the Council of Europe will have to play in the future and to decide on the budget accordingly.

      It could be suggested, in this connection, that additional resources be used, if necessary, to help finance the Organisation. One possibility would be special contributions from ministries other than the foreign affairs ministries to finance activities in areas for which they are responsible. Other resources might be obtained from existing foundations or foundations to be set up in areas of interest to the Council of Europe, which could be called on to help finance specific activities.

      In any event, particular care should be taken to ensure that all the member states and states taking part in activities open to non-members (conventions, partial agreements) pay their contributions within the time-limits laid down in the Council of Europe's Financial Regulations. Any unjustified delay in doing so, quite apart from the fact that it causes the Organisation administrative problems, should prompt measures penalising the state in question (payment of interest, suspension of involvement in certain activities, etc.).

      Other priorities for 1994 which the Assembly would like to stress include, first and foremost, the Organisation's permanent Secretariat which, although growing, has not yet attained the critical mass that would enable it to perform its tasks more effectively. As the increase in staff was sluggish for several years, the current remedial measures, although they go some way to improving the situation, have not yet solved the problem, given the rapid increase in the number of member states and the activities of the Council of Europe, particularly those concerning the countries of central and eastern Europe.

      As it has already requested in the past, the Assembly would also like serious consideration to be given to the Council of Europe's information policy, and coherent measures to be taken in the near future. The information policy is in fact the Organisation's outside image and it concerns an increasingly large target public. Given the lack of information and knowledge about the Council of Europe among European citizens, not only in the old member states but also in states that have just joined the Council of Europe or are about to do so, a special effort is needed to devise a clear and consistent information policy.

      The Assembly is also particularly concerned about the Secretariat's working conditions in both practical and administrative terms. It considers that all the working tools needed (offices, computers, etc.) should be made available to the staff, who serve the Organisation in circumstances that are sometimes difficult. It also sets great store by administrative and legal measures to ensure staff of fair and professionally satisfactory working conditions, whether with regard to staff training, equality between the sexes, the right of negotiation or legal protection for staff.

E.       Conclusions

      The Rapporteur would first like to point out that, despite the adoption of a new budget calendar, the Assembly has not received proposals from the Secretary General or the Committee of Ministers concerning the broad lines of the 1994 budget and the prospects for that budget. It is therefore difficult for it to express an opinion, except in the light of its own view of its own priorities and those of the Organisation as a whole.

      The Assembly therefore feels bound to reiterate its request to the effect that the Council of Europe adapt its structures, resources and activities to the new Europe that is emerging, and that is causing our Organisation to expand rapidly.
