means that it is now more urgent than ever to adopt an overall strategy to
guide the action of the individual states. As the Rapporteur, Mr Cox, points
out, "additional action is necessary. ... The aim of such a strategy is to
inspire action and policies at international and national level and to guide

to the whole are of family affairs and children[3].
Parliamentary Assembly Recommendation 1121 (1990) on the rights of the child
was a turning point in this field, because it finally established the principle
that children have rights which they can exercise independently (see
Mrs Ekman's report, presented by the Committee on Legal Affairs and Human
Rights).

6. The recent European Convention on the Exercise of Children's

the Assembly session, is the immediate response to the concerns set out in
Recommendation 1121 about improving and expediting proceedings before the
ordinary courts involving the interests of children. Its object "is, in
the best interests of children, to promote their rights, to grant them
procedural rights and to facilitate the exercise of these rights by ensuring
that children are, themselves or through other persons or bodies, informed and
allowed to participate in proceedings affecting them before a judicial

Europe, more children than ever are living in high-risk situations. Children
are suffering serious physical or mental ill-treatment: they undergo racial
discrimination, prostitution and violence, and also suffer the negative effects
of the media. Such emergency situations alone are sufficient to force us to

The methodology to be adopted by national authorities in children's policies

priority" and "consider the best interests of the child as a guiding
principle of all action". This concept must be seen in the light of
Resolution 1011 (1993), in which the Assembly invited member and non-member
states to subscribe to the principle of "First call for children".

10. Since proper protection cannot be provided for individuals
with rights unless their needs are ascertained, children must be regarded as a
subject for study in their own right, not by reference to their parents.
Systematic data gathering can give children a conceptual autonomy, and thus
enable activities to be co-ordinated and data exchanged between states for the
purposes of comparison.

11. We must also ensure that every political decision really does
take account of children's interests, inter alia in fields which do not
directly affect them but which could indirectly influence them (the principle
of the "child impact statement", paragraph 7.v).

12. Some other provisions of the draft recommendation stipulate
different ways of effectively safeguarding the principle of "priority for
children": encouraging co-ordination at governmental level by means of a
comprehensive multidisciplinary approach (paragraph 7.iii), meeting the basic
needs of children and dissuading governments from reducing funding for social
prevention programmes (paragraphs 7.vi and 7.vii), etc.

13. The appointment of a commissioner (ombudsman)
(paragraph 7.iv) has already been mentioned in various texts (for example
the Ekman report and Recommendation 1121). In 1985 the Committee of
Independent Experts of the European Social Charter stressed "the
importance of a commissioner (ombudsman) for children because such an official
can act on his/her own initiative or be directly applied to by those
concerned". The wording used in paragraph 7.iv is perhaps too reminiscent
of the Norwegian ombudsman model, which is appropriate for Norway as a small
homogeneous country with a long democratic tradition, but might be unsuited to
the needs of other states.

14. Nevertheless, the introduction of such an institution is an
original, and essential, solution for many states, and presupposes the
necessary guarantees on its independence, particularly with regard to
appointment procedures. In the case of
very large countries, local ombudsmen would also be useful, although they would
remain subject to national supervision.

            3. The
child protection policy which must be adopted

15. While the provision on the explicit recognition in states'
domestic law of children's civil and political rights is a logical one, since
the 1989 Convention is not directly applicable in certain states, it may
nevertheless be regretted that the strategy makes a distinction between civil
and political rights on the one hand and economic, social and cultural rights
on the other, probably because the latter are not enforceable by the
courts. This distinction, however, is
unjustified as the 1989 Convention is a comprehensive text not establishing any
hierarchy between both categories of rights.
It would thus go against its spirit, but also run counter to
Recommendation 1121[4],
to apply this restrictive distinction at national level.

provisions centred on four themes:

about their rights, the training of professionals and the informing of children
about the remedies available to them are essential: if children's rights are to
be given effect, children must be informed of those rights. The publicising of children's rights is a
first step to increase public awareness and promote change in the traditional
