1. In its Recommendation 1212 (1993) on the
adoption of a revised Statute of the Council of Europe, the
Assembly asked the Committee of Ministers to submit to it all
draft conventions, agreements and protocols for assent prior to
adoption. The Committee of Ministers has not yet taken a decision
on this specific request.

2. Recommendation 1212 (1993) was one of the
initiatives taken by the Assembly with a view to preparation of
the first Council of Europe Summit.

3. Now that the second Summit is approaching, the
time has come to reactivate this proposal. A co-decision
procedure should be introduced for the adoption of conventions,
agreements and protocols. Conventions would be opened for
signature only when they had been approved by the Committee of
Ministers and the Assembly.

4. This is why the Assembly recommends that the
Committee of Ministers should undertake to adopt no further
conventions, agreements or protocols without first submitting
them to the Parliamentary Assembly for opinion. Obviously, a
procedure for implementation of this co-decision process will
have to be agreed between the Assembly and the Committee of
Ministers.
