Protection of minors
Motion for a recommendation

The Assembly,
Considering that a total of twelve children died this summer of asphyxiation in the boot of the family car, where they had been trapped by absent-minded parents while playing an innocent game of hide-and-seek;
Noting that the twelve children who died were between two and six years of age, a highly vulnerable age requiring constant adult supervision and all necessary measures to avoid any fatal errors;
Taking note of the Final Declaration of the Second Summit of Heads of State and Government signed in Strasbourg on 11 October 1997, which seeks to strengthen co-operation between member states in the interests of legal protection of minors;
Expressing the most absolute respect possible for Article 19 of the UN Convention on the Rights of the Child ratified by all Council of Europe member countries, which states that "States Parties shall take all appropriate legislative, administrative, social and educational measures to protect the child from all forms of physical or mental violence, injury or abuse, neglect or negligent treatment",
Recommends that the Committee of Ministers encourage Council of Europe member states to consider the expediency of introducing, in their domestic legislation, the obligation for car manufacturers to install automatic opening devices inside car boots thus enabling these minors to save their own lives.
