Peace, democratic stability and sustainable development in the Mediterranean and Black Sea basins: the role of interparliamentary co-operation

Report

Committee on the Environment, Regional Planning and Local Authorities

Rapporteur: Mr Jean Briane, France, Group of the European People's Party

Summary

As all countries of the Black Sea and the north Mediterranean basins are members of the Council of Europe, the Organisation has an appropriate framework for developing dialogue between local and regional authorities and national parliaments of the two sea basins.

Co-operation at this level would contribute to restoring peace, democratic stability and sustainable development in the region and would complement, in a coherent manner, the actions of intergovernmental co-operation undertaken within the Barcelona process of the European Union.

Subsequently, the Assembly intends, on the one hand, to develop co-operation with other parliamentary Assemblies such as the Parliamentary Assembly of the Black Sea Economic Co-operation (PABSEC) and the Inter-Parliamentary Union (IPU), and on the other hand, to enhance links between specific committees of the Assembly and corresponding committees of respective national parliaments in the countries belonging to the two sea basins.

I.       Draft resolution

1. In 1985 the Parliamentary Assembly organised the First Conference of Mediterranean Regions in Marseilles in co-operation with the Standing Conference of Local and Regional Authorities of Europe. Since then, four other Conferences have taken place.

2. Although local and regional authorities in the Mediterranean basin share the same problems, they are not well placed to develop or benefit from co-operation that would help them to find common solutions. The aim of the Conferences was therefore to bring together representatives of the parliaments and those regions of the countries bordering on the Mediterranean on a periodic basis in order to identify opportunities for contributing to the sustainable development of the region.

3. The Conferences thus fit into the general framework of existing co-operation, which takes place at different levels, whether at bilateral or multilateral intergovernmental level or at the level of non-governmental organisations operating in different fields such as education, culture, the environment and youth affairs.

4. Despite a wide range of activities, the results of this co-operation are often limited in relation to the resources expended and do not meet the standard of priority action which the security and development of the region requires.

5. This was clearly the reason why the European Union took the initiative in November 1995 of launching – at the Barcelona Conference – an extensive intergovernmental programme for partnership between the Union and the countries of the southern shore of the Mediterranean.

6. The enlargement of the Council of Europe after 1992 included also 5 Mediterranean-basin countries - Bulgaria, Albania, Croatia, "the former Yugoslav Republic of Macedonia" and Slovenia as full members, which made the Council of Europe a good institutional framework for Mediterranean co-operation.

7. On the other hand, in 1992, the countries bordering on the Black Sea also decided to start co-operating both at intergovernmental level (Black Sea Economic Co-operation, BSEC) and at parliamentary level (Parliamentary Assembly of the Black Sea Economic Co-operation, PABSEC).

8. Since all the states of the Black Sea basin are members of the Council of Europe, or associated in some way with it, the Council of Europe is in an ideal position for dealing in a comprehensive manner with the problems, especially those of a political nature, that affect both basins.

9. Following the 4th Conference of Mediterranean Regions in Cyprus in September 1995 and on the basis of the outcome of the First Interparliamentary Conference on the Environmental Protection of the Black Sea (Istanbul, July 1996), it was decided that the enlargement of the Council of Europe to the Black Sea countries and fact that the Mediterranean and Black Sea basins form a single “eco-system” and that the countries in the two basins share many problems would justify a comprehensive approach to co-operation in the region.

10. The Assembly considers that the institutional framework of the discussions held through these Conferences, in co-operation between parliaments and local and regional authorities, means that the Council of Europe’s approach is unique in character and usefully complements other major co-operation initiatives and those of the European Union.

11. Moreover, as the systems of local and regional government in the countries in the two basins differ greatly from one country to the other and, in certain cases, still do not fully comply with the principles of local and regional democracy promoted by the Council of Europe, interparliamentary co-operation could also contribute to the establishment at local and regional level of democratic structures and methods of operation that enable the principle of solidarity to be applied.

12. To this end, intensified relations between the national parliaments of all the countries in the two basins, both members and non-members of the Council of Europe and the Parliamentary Assembly, could be an ideal means of co-operation in priority areas such as legislative reform and accession to, and implementation of, relevant international conventions and legal instruments.

13. Furthermore, the Assembly welcomes the interparliamentary dialogue, which was set up at the initiative of the President of the Italian Parliament, and which complements in an appropriate way the "Barcelona process" of the European Union.

14. While having decided to extend its reflections to the countries of the Black Sea basin, the Assembly recognizes that it must not lose sight of the problems specific to each basin – on the one hand, the economic, demographic and sociopolitical problems of the countries of the southern shore of the Mediterranean, which threaten to undermine peace and stability in the region, and on the other, the problems of environment, shipping and lack of co-operation between riparian countries, which appear to be priorities for the Black Sea basin.

15. The 5th Conference in the series therefore examined interparliamentary and interregional co-operation in the Mediterranean and Black Sea region and, in particular, the contribution such co-operation could make to peace, democratic stability and sustainable development.

16. Particularly concerned about the environmental situation, the Assembly is convinced of the need to give priority to those major problems which are having a decisive impact on economic and social development and even on the political stability of the region of the two sea basins, and of the priority that should be given to actions designed to raise public awareness and inform and educate all citizens about environmental management and a culture of peace.

17.       Accordingly, the Parliamentary Assembly:

a) approves the conclusions of the preparatory group for the 5th Conference of Mediterranean and Black Sea Basins held in Marmaris on 25 and 26 February 1999 and, with more particular regard to action possible at parliamentary level :

i.       decides to intensify its relations with the specialist committees in the national parliaments of the member countries and non-member riparian countries which have responsibility for the priority issues of sustainable development in the region, such as the environment, culture, education, migration and local and regional government, and to ask its relevant committees to open up some of their meetings to them;

ii.       endorses the proposal to prepare, in close association with the partner countries concerned and in co-operation with the Congress of Local and Regional Authorities of Europe and the relevant committees, a Charter for Sustainable Development of the Mediterranean and Black Sea Basins whereby national parliaments, regions and towns would pledge their resolve to undertake more intensive co-operation and to commit themselves to certain key principles that should guide them in any interventions likely to have an input on the ecological balance;

b)       desires to study with the Parliamentary Assembly of the Black Sea Economic Co-operation (PABSEC), the Inter-Parliamentary Union (IPU) and the Parliamentary Assembly of the Central European Initiative opportunities for intensified co-operation;

c) welcomes the proposal of the Bulgarian national delegation to organise the 6th Conference of Mediterranean and Black Sea Basins in Varna in October 2000.

1. History of Parliamentary Assembly activities in this sphere

The idea of co-operation between the Parliamentary Assembly and the Standing Conference of Local and Regional Authorities of Europe (now the Congress of Local and Regional Authorities of Europe — CLRAE) on a series of conferences devoted to the issues specific to the Mediterranean regions goes back to the early 1980s.

Thus it was that the 1st Conference of Mediterranean Regions was held in Marseilles in 1985. There have since been four others, the most recent of which is the subject of this report.

The primary aim of these conferences was to assist in bringing about such conditions, by increasing co-operation between the towns and regions of the Mediterranean basin, as would ensure sustainable development in the zone while conserving its historical, cultural and social legacy.

The themes of the first four conferences were paramount to the sustainable development of the Mediterranean. They included such issues as the management of coastlines and water resources, environmental protection, tourism policies and migration.

Moreover, in the course of different activities run by this Committee and others, the Parliamentary Assembly has frequently addressed other issues which chiefly concern the Mediterranean but are also of interest to the Black Sea regions.

In the context of the 1993-4 “Freshwater Europe” action programme, for example, there were parliamentary hearings and seminars on water management in the Mediterranean regions. For its part, the Committee on Agriculture and Rural Development also considered problems relating to agriculture in the Mediterranean, and the Committee on Migration looked at the population and migration issues affecting the region. More recently, the Committee on Economic Affairs and Development drew up a report on economic development in the Mediterranean, with particular reference to the encouragement of SMEs.

As regards the Black Sea, the Environment Committee made proposals back in 1992 for a Council of Europe initiative on the Danube, the principal effect of which would be to reduce the devastating ecological impact of pollution from the river on the Black Sea.

A further important event was the first Interparliamentary conference on the Environmental Protection of the Black Sea, which was organised jointly by the Parliamentary Assembly and the Parliamentary Assembly for Black Sea Economic Co-operation (PABSEC), and held in Istanbul in July 1996.

These “landmarks” have been mentioned in order to underline how much the Parliamentary Assembly is aware of the importance of assisting sustainable development in the Mediterranean and Black Sea basins, and to demonstrate that interparliamentary co-operation, which is dependent inter alia on the endeavours of the Assembly, could be highly significant in this respect.

2. The role and changing scope of the conferences

A few weeks after the 4th Conference of Mediterranean Regions (Cyprus,
20-22 September 1995), the first Euro-Mediterranean Conference was held in Barcelona. This was the first stage in a wide-ranging European Union programme of intergovernmental co-operation in the region.

The EU initiative very clearly reflected the growing awareness in that organisation that security must be increased in the Mediterranean basin at a time when developments such as the rise of Islamic fundamentalism, traditionalism and migration were becoming important destabilising factors, compounded by the worsening economic situation and rapid population growth.

For all these reasons, the EU decided to embark on an ambitious policy, one of the goals of which is to help set up a trading area conducive to making the best use of the region’s potential and thereby bringing into existence a major new economic and political partner.

In the medium to long term, this extensive project, whose already very substantial financial allocation from the EU is set to increase with time, could well result in a free trade area bringing together 800 million people in some forty countries.

In view of the above, the Recoder report of January 1998, which summed up the 4th (Cyprus) Conference and drew its implications for the future, identified a need to review the aims of the various international organisations operating in this area in order to avoid duplication of effort and ensure the best possible division of duties within the multilateral co-operation process. Each player should be able thereby to contribute to that process in a way consistent with its specific resources, remit and authority.

In this respect, the Recoder report very rightly stressed that the Council of Europe should concentrate on developing co-operation at parliamentary level and at that of local and regional authorities.

Meanwhile, the first Interparliamentary Conference on the Environmental Protection of the Black Sea (Istanbul, July 1996), which was organised by the Parliamentary Assembly and the PABSEC, clearly demonstrated how closely the fates of the Black Sea and the Mediterranean are intertwined, given that the two seas in fact share a common ecosystem.

Given this essential fact relating to the ecological issues facing the two seas and the fact that all states bordering on the Black Sea enjoy full membership of the Parliamentary Assembly or special guest status, it was proposed that the Assembly should extend the scope of its conferences to cover both the Mediterranean and the Black Sea and give priority to co-operation of an interparliamentary and interregional nature.

Indeed, in keeping with the spirit of the Recoder report, it had become important to embark upon a new phase of co-operation, marked by a forum for political dialogue which would allow parliaments and interparliamentary organisations from the two basins to meet and work towards a common strategy for sustainable development in the region. At the same time, a similar dialogue would develop at the local and regional level. A formula would need to be devised by which to combine the two dialogues.

Without entering into detail on the results of the Cyprus Conference, it should be pointed out that the Recoder report marked a turning-point and merits careful attention for the very interesting light it sheds on a possible future role for the Assembly in this process.

3. 5th Conference of the Mediterranean and Black Sea Basins

3.1. Changes between the 4th Conference (Cyprus, 1995) and the 5th Conference (Marmaris, Turkey, 1999)

The 5th Conference therefore marked a change in direction for Mediterranean co-operation as developed through the thought given to the series of Mediterranean conferences by the Parliamentary Assembly and the CLRAE. Not only was co-operation expanded to include the Black Sea basin, but it also reflected a decision, reached on the basis of the conclusions and texts adopted after the 4th Conference, to focus on more institutional topics and on the legal instruments by which enlarged interparliamentary and interregional co-operation can contribute to sustainable development in the region.

As regards interparliamentary co-operation in particular, the Environment Committee has frequently remarked that co-operation between the Parliamentary Assembly and national assemblies — whether of member or non-member states — should be developed in the context of a true political forum where the Assembly’s skills and experience could be placed at the disposal of national parliaments.

The other element which these conferences have developed is that of co-operation between local and regional authorities. To be more accurate, priority has been given to regional authorities since, in keeping with decentralisation and the application of the principle of subsidiarity as we understand it, at least, this level of power is directly subsidiary to national government.

A certain difficulty arises in that, while all countries represented at these conferences have a national parliament, they do not all have administrative bodies comparable to the regional authorities; even where they do exist these authorities may have a wide range of different powers and forms. This undeniably presents an obstacle to interregional co-operation in the two basins, because partners in talks cannot always negotiate or act with the same degree of authority.

Nonetheless, all the states concerned — or those of a certain size at any rate — are taking part, or will do so fairly soon, in a process of regionalisation which should in the long run permit a form of interregional dialogue where genuine co-operation is possible.

In order to carry through regionalisation, or indeed to review the powers of local and regional authorities, it will be necessary for parliaments to introduce appropriate legislation. This will mean a further opportunity for co-operation between the Parliamentary Assembly and national parliaments.

The use of interparliamentary co-operation in the search for sustainable development in the Mediterranean and Black Sea basins will therefore bring a twofold benefit: it will promote debate and the sharing of skills and experience in specific areas connected with sustainable development, and it will give national parliaments which so desire greater access to the Council of Europe’s expertise and instruments in the field of regionalisation and local democracy.

There can be no doubt that these five conferences have contributed to a process of dialogue. The challenge now, however, is to ensure that this dialogue reflects a firm and lasting commitment and that it is solidly rooted in the practices of the parliaments and local and regional authorities concerned.

3.2. Proceedings of the 5th Conference

The 5th Conference of the Mediterranean and Black Sea Basins took place in Marmaris (Turkey) from 25 to 27 February 1999, on the theme “Interparliamentary and interregional co-operation for peace, democratic stability and sustainable development” (see the conference programme in Appendix 5.1).

The aim of the conference was to look into ways of encouraging and developing interparliamentary and interregional co-operation, especially by means of legal instruments concluded by the Council of Europe, as factors for peace, democratic stability and sustainable development.

Following the official opening session, proceedings got under way with a presentation by Prof.Driss Khrouz, of the University of Rabat, who reported on the general situation of and prospects for co-operation in the region. He gave a very pertinent reminder that the co-operation programme launched by the EU at the Euro-Mediterranean Conference in Barcelona was primarily an intergovernmental initiative and one which essentially focused on security and commercial issues.

Thanks to this information, it is possible to define more clearly the scope of the Council of Europe’s co-operation policy, which is essentially concerned with achieving sustainable development through institutional and political means.

Moreover, this policy should in future be grounded in the guidelines contained in a document to be prepared by the Parliamentary Assembly and the CLRAE in accordance with the request made by the 5th Conference.

Following Prof. Khrouz’s background report, the first working session was devoted to interparliamentary co-operation, with particular reference to its various current forms in the Mediterranean and Black Sea region. In this connection, mention should be made of the admirable and very welcome contribution to the region’s development by co-operation under the auspices of the PABSEC, the Inter-Parliamentary Union (IPU) and the European Parliament.

As your rapporteur, however, I also understand, and partly share, the concern of some that there are too many initiatives in this domain. Yet the equally strong desire to see the birth of productive partnerships means giving support and encouragement to existing individual projects and promoting inter-institutional co-operation, although always with a view to achieving the best possible results.

In this spirit, given the means at each organisation’s disposal, and in spite of possible reservations, I remain convinced that it is worth considering a more structured approach to co-operation between the Assembly, the PABSEC and the IPU.

The second working session focused on local and regional partnerships and on the possibilities offered by Council of Europe instruments, in particular the contribution which the European Charter of Local Self-Government, the European Outline Convention on Transfrontier Co-operation between Territorial Communities or Authorities and the Additional protocol to the latter, on inter-territorial co-operation, were able to make to peace and democratic stability.

Other issues raised during this session were the preparation of a European charter of regional self-government and the importance of regional authorities to sustainable development policies.

The Mayor of Gaza, Mr Aown Shawa, reported on the friendship and co-operation agreement concluded between Gaza, Tel Aviv and Barcelona to mark their mayors’ commitment to improving stability and the prosperity of the cities’ inhabitants. This experiment demonstrates very well how projects at local level can complement and occasionally take the place of those undertaken at national level. At times of international tension, friendship between towns can be a way of maintaining links and thus ensuring a minimum of contact between governments.

Accordingly, it is crucial that such municipalities should be granted the powers, internal structures and financial resources necessary for them to carry out their duties effectively.

The third session turned to a major issue for the region: that of sustainable development. The theme was introduced by Prof. Mario Pavan, who reported on the environmental situation in the two basins. These are connected by straits and form a single ecosystem. Not only is the Mediterranean suffering damage at the hands of coastal states; its connection to the Black Sea — the most polluted sea on the planet — means that it is also affected by pollution from that source.

The ecological situation in these seas requires carefully co-ordinated action both on the part of all coastal states and on that of all states in the catchment area of the two basins, including those lying along rivers which, like the Danube, are very largely responsible for the deterioration of the Black Sea.

Pleading in favour of such action, Prof. Pavan insisted that the Committee of Ministers of the Council of Europe should be asked once again, despite its earlier refusal, to declare a “Mediterranean and Black Sea Protection Year”.

The Italian military authorities present, who had been invited in order to report on a large-scale public awareness campaign launched by the ministry in charge of the Italian Navy, stated their readiness to take part in a Europe-wide initiative such as a “Mediterranean and Black Sea Protection Year” by making the training vessel Amerigo Vespucci available for use.

The third session also stressed the urgency of tackling water quality in the Danube, implementing existing legal provisions for improving the situation and recognising the potential role of NGOs.

Lastly, it was considered crucial in this context to reiterate the importance of the issue of freshwater supplies, quality and access for all countries in the region, and especially for the Mediterranean states. More than anywhere else, it is vital that these countries devise a global approach to water management based on maintaining water quality and quantity and recognising that access to fresh water is a fundamental human right. Water should not be seen as an exclusively economic commodity, for it also has a social value. Moreover, it is regrettable that there is as yet no international legal treaty on the matter. As Ms Houria Tazi Sadeq, Chair of the Alliance Maghreb-Machrek pour l’Eau (ALMAE), so rightly said, it is time to introduce legislation on the right of fair access to water, this being both part of the right to a healthy environment and a basic development right.

The closing session was chaired by Mr Luchezar Toshev, Vice-President of the Parliamentary Assembly and a member of the Committee on the Environment, Regional Planning and Local Authorities.

Mr Mehmet Buldanli, CLRAE Rapporteur, delivered the closing speech, and I was given the task of presenting the Final Declaration.

As in the case of the previous conferences, a draft final declaration had been proposed by the working group responsible for preparing the conference. This document had been distributed ahead of time so that those who wished to do so could table amendments.

When the time came to adopt the Final Declaration, it was decided, at the suggestion of Mr Miguel Ángel Martinez and given the disparity in status between conference delegates, that a formal adoption would be impossible. Instead, the conference should merely take note of the conclusions presented by the preparatory working group and ensure their submission in that form for further action by the various bodies of the Council of Europe.

In view of the increasing complexity of the issue at hand, the large number of delegations and the presence of delegates from states not members of the Council, it would probably have been justifiable strictly to enforce a conference rule of procedure by which those entitled to vote could be clearly identified. Such a rule will be ready as of the next conference, which is due to take place in Varna (Bulgaria), late in the year 2000.

Although this confusion is regrettable and could, I believe, have been avoided, I am convinced that it does nothing to detract from a text which abounds in constructive proposals and indicates extremely clearly what part the Parliamentary Assembly and the CLRAE can play in this sector.

3.3. Follow-up

Both the Black Sea and, more especially, the Mediterranean have been the focus of an enormous number of programmes, projects, initiatives, declarations, international agreements and the like.

These have been implemented, as the case may be, on an intergovernmental, bilateral or multilateral basis, by NGOs or in some other manner.

Notwithstanding such a proliferation of activities, the environmental situation in the region remains just as unsettling and its political instability just as overwhelming, fundamentalism is still on the rise and the lethargic pace of development still as responsible for huge differences between the various coastal states.

As regards the Mediterranean, following the 1st Euro-Mediterranean Conference in Barcelona the EU showed willingness to encourage interregional co-operation. This had been the primary aim, back in 1985, of the Council of Europe’s Marseilles Conference. Still within the EU, moreover, the Speaker of the Italian Chamber of Deputies took the initiative of convening a meeting of his counterparts from the other member states. The European Parliament followed up this initiative by organising the “Euro-Forum”, which aims to bring together representatives of the EP and members of parliaments from the southern shore of the Mediterranean.

It is encouraging that the “Barcelona process” has resulted in parallel developments at national and regional/local level in the EU member states. This sends a clear signal that the will exists to see projects attain their goals and to achieve tangible results from all ongoing initiatives.

In the case of the Black Sea, the BSEC and the PABSEC provide a suitable platform for effective intergovernmental and interparliamentary co-operation between coastal states.

In view of the above, it would seem entirely logical to make the Parliamentary Assembly of the Council of Europe the forum for parliamentary dialogue where the coastal states of the single “system” to which the two basins belong could confer and seek common solutions to common problems.

Moreover, the Assembly is also in a position, as regards interregional co-operation, to make a valuable contribution to institutional developments in any country in respect of the powers, resources and statutes of local and, more particularly, regional authorities. As for the CLRAE, it could provide a forum where local and regional authorities in the Mediterranean and Black Sea states would meet for talks.

Among all the initiatives undertaken in this area, particular mention should be made of the work of the IPU.

In 1992 the CSCM process (Conference for Security and Co-operation in the Mediterranean), which was inspired by the example of the CSCE (Conference for Security and Co-operation in Europe) but specially adapted to the needs of the Mediterranean, kicked off in Malaga with the first Inter-Parliamentary Conference on Security and Co-operation in the Mediterranean. The main participants in the conference were the 21 coastal states, while Palestine, the USA, the Russian Federation and the United Kingdom had associate status. Other participants in the process are parliamentary institutions and organisations such as the Parliamentary Assembly, the PABSEC and the European Parliament.

Like the CSCE process, the CSCM process consists of three “Baskets” whose themes are addressed at a special meeting held between two conferences.

The advantage of the CSCM process is that it offers all the states of the Mediterranean basin a platform for dialogue on equal terms in their capacity as members of the IPU.

Moreover, following the example of the Parliamentary Assembly, the PABSEC has been given observer status in the process, with the result that co-operation has been extended to the Black Sea countries.

The geographical extent of Mediterranean co-operation at the IPU is therefore identical to that at the Parliamentary Assembly; consequently, it would probably be useful to consider co-operation in this sphere between the two bodies.

Independently of this idea of co-operation, which needs to be investigated by the two assemblies’ secretariats working together, the Parliamentary Assembly should be encouraging both its Environment Committee, which has primary responsibility in this domain, and other committees potentially concerned, to intensify co-operation with their counterparts in national parliaments in order to generate a suitable atmosphere for focused and systematic talks.

During the 5th Conference, as on many other occasions, the issue was raised of increasing awareness among the various groups — both specialised and unspecialised — concerned by these matters. Awareness-raising programmes, which should also be supported by national parliaments, would concentrate on promoting such basic concepts as local democracy, local and regional self-government, citizenship and tolerance.

An Assembly project of this sort on behalf of and in association with national parliaments could be based on the principles of the forthcoming Charter, to be prepared by the Assembly and the CLRAE, for sustainable development of the two basins.

4. Conclusions

Fifteen years after the first conference, a general appraisal of the five conferences leads to the conclusion that their conception was laudable and that they met a real need at the time.

The first four conferences were an opportunity to identify very clearly the major regional issues in the fields of environmental protection, resource management, migration and local self-government; they also shed light on the role which bodies like the Parliamentary Assembly and the CLRAE could play in this sector. Consequently, it is crucial, when considering all initiatives, to take account of what these institutions can contribute.

The effect of the launch, at the 1995 Barcelona Conference, of the EU's intergovernmental co-operation programme with the southern shore of the Mediterranean was to compel the Council of Europe to narrow its focus to local authorities and to issues within the competence of national parliaments. In order to avoid duplication of effort, and given the disparity in resources, it seems evident that the Council should steer clear of regional co-operation issues in the Mediterranean, although action at the national and local levels does appear to be warranted.

Such action seems all the more appropriate in view of the new framework for co-operation in existence since the Istanbul Conference on the Environmental Protection of the Black Sea (July 1996) and the Council’s enlargement to include all the Black Sea states.

Thus it was that the Marmaris Conference, the first on interparliamentary and interregional dialogue in the Mediterranean and Black Sea basins, offered a fresh perspective on co-operation throughout the region.

I am convinced of the merits of co-operation, which may bring concrete results and provide an effective platform for dialogue between the parliaments and local authorities of the countries concerned. I also believe that issues addressed in this way conform entirely to the Council’s specific emphasis and general mandate.

As mentioned above, co-operation with other international organisations such as the PABSEC and the IPU could not but be advantageous, inasmuch as it would enable more tangible results to be achieved while avoiding the duplication of effort. Accordingly, our aim must be a spirit of consultation and commitment to the interests of the Mediterranean and Black Sea states. As your rapporteur, I sincerely hope that we achieve this aim.

PRESS RELEASE

Towards a Trans-Mediterranean and Black Sea Charter for sustainable development and democratic stability

MARMARIS (Turkey), 26.02.99 – Meeting within the framework of the COUNCIL OF EUROPE's Fifth Conference on the Mediterranean and Black Sea Basins, more than 200 representatives of riparian States' parliaments, regions, municipalities and NGO's have called for a Charter of Inter-Parliamentary and Inter-Regional Cooperation for Sustainable Development.

Delegations from Algeria, Egypt, Jordan, Morocco, Tunisia and the Palestinian Authority joined in discussions on how to address, on a concerted basis, the ecological disaster which has long threatened the Black Sea and now imperils the Mediterranean –notably through stronger inter-parliamentary, inter-regional and inter-municipal cooperation.

The Conference was convened in Marmaris, at the invitation of the Turkish Parliament, by the Council of Europe's Parliamentary Assembly and its Congress of Local and Regional Authorities of Europe (CLRAE). It was addressed by the Uluc Gurkan, Interim President of the Turkish Grand National Assembly ; by Luchezar Toshev, Vice-President of the Parliamentary Assembly ; and by Alain Chenard, President of the Congress. It heard statements on behalf of the Hungarian Chairmanship-in-Office of the Committee of Ministers of the Council of Europe (Ambassador Janos Perenyi) and of the Parliamentary Assembly of the Black Sea Economic Cooperation (Secretary General Faik Kaytanci). Miguel Angel Martinez, President of the Inter-Parliamentary Union (IPU) also addressed the Conference and chaired a working sitting.

Said Lale Aytaman, Chairperson of the Council of Europe's Parliamentary Committee on the Environment, Regional Planning and Local Authorities – following final review of draft conclusions presented by Jean Briane, Chairman of the Conference's preparatory group :

"We have shown that we can mobilize the constructive forces for cooperation of virtually all the riparian countries of the single ecological system which is formed by the Mediterranean and Black Sea Basins via the Sea of Marmara and the Straits of Istanbul and Canakkale. The Charter which we propose should provide a basis and an inspiration for action by Governments and regional and local authorities and State agencies and by all other international organisations which have programmes to prevent irreversible damage to our environment. My Committee – and the Congress – will now draw up recommendations based on the draft conclusions and amendments which have been presented".

CONCLUSIONS

The participants in the 5th Conference of the Mediterranean and Black Sea Basins, held in Marmaris, Turkey from 25 to 27 February 1999, thank the Council of Europe and in particular its Parliamentary Assembly and Congress of Local and Regional Authorities for organising this Conference.

They also express their sincere gratitude to the Turkish Parliament, the Governorate of Mugla and the Municipality of Marmaris for their welcome and their hospitality.

They take note with interest of the conclusions presented by the Working Group responsible for the preparation of the Conference, and decide to transmit them for further action to the Parliamentary Assembly of the Council of Europe and the Congress of Local and Regional Authorities of Europe.

Considering that:

1. The process of co-operation between the countries on the Northern, Southern and Eastern shores of the Mediterranean and Black Seas has operated for several years in the context of intergovernmental moves such as the Euro-Mediterranean Partnership launched by the European Union in Barcelona in 1995, the co-operation between the Black Sea countries (PABSEC) or the initiatives taken by other international organisations;

2. It is plainly crucial that this co-operation process should be substantially strengthened, particularly with regard to sustainable development, peace and democratic stability, and pursued not only at intergovernmental level but also at interparliamentary level as well as among the local and regional authorities of the countries in the Mediterranean and Black Sea Basins;

Moreover, in view of the obstacle to co-operation raised by disparity between the countries fringing the two basins in the organisation and empowerment of local and regional authorities, interparliamentary co-operation forms a vital supporting instrument for the introduction of structures and machinery to ensure true democracy and local self-government;

4. The Mediterranean and Black Seas are interconnected and consequently share many serious environmental problems and, from an ecological standpoint, form one and the same system. Thus, despite the distinctive features of each basin, these two seas warrant comprehensive action covering the entire region.

Also aware that, with regard to:

The Mediterranean Basin

5. This region is characterised by large human and natural resources and thus strong development potential, but also by disturbing social, economic, demographic and ecological imbalances which may constitute a threat to the future of the societies dwelling there and intensify the migration flows which the countries north of the basin no longer have the capacity to absorb;

6. The severe environmental degradation in the Mediterranean Basin has many causes, notably tourism which, despite its undeniably positive effects on economic growth and employment, is nonetheless to blame for a tangible deterioration in the cultural heritage, natural resources and scenery;

7. Grave obstacles, or sometimes lack of clearly stated resolve, persist and are specifically linked with the political structures of certain countries; consequently, they impede effective co-operation between the Northern, Southern and Eastern shores of the Mediterranean; these political hindrances also have repercussions on interparliamentary and interregional co-operation in the Mediterranean Basin;

The Black Sea

8. Its environment is in a very serious state owing to grave impairment of its biodiversity, fisheries resources and landscape, and necessitates concerted action by the riparian countries which, following the geopolitical changes that have occurred in the region, can enter into co-operation founded on democratic and participatory processes;

9. Such co-operation, implemented at various levels, is furthermore the imperative means to remedy the principal causes of this decline, including pollution from land-based sources and carried by rivers, uncontrolled tourism and intensive, potentially hazardous navigation;

10. As literal "genetic bridges" between the Mediterranean and Black Sea Basins, the Straits and the Sea of Marmara are subjected to some of the world's densest sea traffic. The resultant pollution severely affects the ecosystem of the straits. Moreover, the traffic creates risks of shipping accidents which would have disastrous consequences for the environment;

The entire region

11. Having regard to the various causative factors of environmental degradation in both the basins, including pollution from large rivers such as the Danube and the Dnepr, it is plainly apparent that the riparian countries are not the only ones responsible for this situation, ascribable to quite a number of other countries not actually on the seaboard but contributing to marine degradation by generating land-based and river-borne pollution;

12. Given the geographical scale and the geopolitical and historical significance of the area, it is essential that the Council of Europe express its interest in the region and its commitment to the discovery of new balances and the assertion of a new identity for the region with a view to preserving its values and assets;

13. The Mediterranean and Black Seas must accordingly become a frame of reference for Europe and a prime setting for relations between their riparian states as well as between these states and others.

In the light of the foregoing, the Working Group states its conviction that:

14. One of the priority channels for solving the problems that beset the region may be found through effective, intensified international co-operation relying on practical actions which are themselves founded on clear political commitments;

15. The Council of Europe, notably with the enlargement of its membership since 1989, provides the appropriate framework for enhanced interparliamentary and interregional co-operation in the area, and can be a genuine platform for dialogue among the national and regional institutions concerned;

16. Significant resources must be deployed in order to encourage, actuate and co-ordinate genuine co-operation on the issues of peace, democratic security and environment in the Mediterranean-Black Sea region between parliaments and local and regional authorities, with which citizen organisations would be associated;

17. The national parliamentary committees responsible for the issues raised during the conference and especially for legislative reform could benefit from the Parliamentary Assembly's experience in this sphere;

18. Strengthening decentralised, specifically Euro-Mediterranean, co-operation would secure some of the prerequisites for liberalisation of exchanges (in particular by modernising local and regional government systems and consolidating infrastructures), and would foster more complete intercultural knowledge and understanding by developing direct interterritorial and intercommunity relations;

19. The insufficiency of the autonomy granted to local, and above all regional, authorities in certain countries of the Southern and Eastern Mediterranean hampers decentralised co-operation in the region; it was precisely to encourage such co-operation and to enhance decentralisation and local autonomy, democratic administration, information and training of municipal staff and elected representatives in the Mediterranean partner countries not belonging to the Council of Europe, that the Congress of Local and Regional Authorities of Europe in 1997 formed the Working Group for "Euro-Med" co-operation on local democracy, whose activity deserves to be stepped up;

20. In this context, it is proper to welcome the contributions and achievements of other agencies and to take account of activities implemented:

- firstly by parliamentary assemblies such as the Inter-Parliamentary Union (IPU), which should receive full support in its initiative concerning the Conference on Security and Co-operation in the Mediterranean (CSCM), and the Parliamentary Assembly for Black Sea Economic Co-operation (PABSEC), in conjunction with which the Council of Europe Parliamentary Assembly organised the first Interparliamentary Conference on the Environmental Protection of the Black Sea (Istanbul, 1996);

- secondly in the framework of organisations representing local and regional authorities, such as the Conference of Peripheral Maritime Regions of Europe (CPMR) and especially its Inter-Mediterranean Commission whose opening to local and regional authorities of the countries in the south and east of the Mediterranean Basin should be encouraged, and the Council of European Municipalities and Regions (CEMR) whose activity to promote twinnings and partnership through the ECOS-Ouverture Programme should be stepped up, and the Association of European Regions (AER) which represents both Mediterranean and Black Sea regions.

Invites the Conference to call upon:

The countries concerned

21. To undertake to abide strictly by the obligations arising from current international treaties on protection of the marine environment, in particular the International Convention for the Prevention of Pollution from Ships (MARPOL, 1973 and 1978), the Convention on the Protection of the Mediterranean against Pollution (Barcelona, 1978) and its protocols, the Convention on the Protection of the Black Sea against Pollution (Bucharest, 1992) and the ministerial Declaration on the Protection of the Black Sea (Odessa, 1993);

22.
23. Especially the countries on the southern and eastern shores of the Mediterranean Basins to envisage, on the basis of a more explicit commitment on their part, closer co-operation with the Council of Europe, for instance by stating their intention to involve themselves in the activities conducted under legal instruments or in the framework of bodies open to their participation, such as the Berne Convention (1979) on the conservation of European wildlife and natural habitats, the European Centre for Global Interdependence and Solidarity ("North-South Centre") and the Co-operation Group for prevention of, protection against, and organisation of relief in major natural and technological disasters;

24. To adopt a spatial planning policy consistent with sustainable development, under which coastal areas in particular must be protected against excessive urbanisation;

25. To take concrete action to promote the role of the Council of Europe as a forum of dialogue between Mediterranean and Black Sea countries with the view to strengthening co-operation for peace, human rights, democratic stability and sustainable development;
