The case of Ilie Ilaşcu

Motion for a resolution

presented by Mr Prisăcaru and others

This motion has not been discussed in the Assembly and commits only

the members who have signed it

The Assembly,

1.       Recalls its Resolution 1187 (1999) on “Europe, a death penalty free continent”;

2.       Recalls that the death penalty is both inhuman and degrading, that it has been abolished by an overwhelming majority of Council of Europe member states and that now none of its members execute persons condemned to death;

3.       Recalls the 6th Protocol to the European Convention on Human Rights concerning the abolition of the death penalty:

4.       Is deeply concerned about the death sentence pronounced against one of the members of the Romanian parliamentary delegation, Mr Ilie Ilaşcu, by the “courts” of the so-called “Republic of Transnistria”;

5.       Expresses its deep concern about the existence of zones in Europe which are part of Council of Europe member states but in which international law, and in particular the European Convention on Human Rights, does not apply;

6.       Urges “the authorities” which detain Mr Ilie Ilaşcu to respect the principles enshrined in the European Convention on Human Rights and its additional protocols;

7.       Calls upon these “authorities” to deliver Mr Ilie Ilaşcu to any member state of the Council of Europe where he could be retried.
