Simplification of the procedure for including elections on the agendas for Assembly part-sessions

Motion for a resolution

presented by Mr Svoboda and others

This motion has not been discussed in the Assembly and commits only

the members who have signed it

The Assembly,

1. Notes that it can sometimes become necessary to hold elections by the Assembly of judges of the European Court of Human Rights after the agenda of an Assembly part-session has been adopted;

2. Recalls that under Rule 25.4 of the Assembly’s Rules of Procedure the inclusion of such elections on the adopted agenda is only possible under urgent procedure and that this requires a two-thirds majority of votes cast (Rule 50.4.);

3. Stresses that elections are held parallel to plenary debates which are thus not interrupted and therefore they have no relevance on the time reserved for debates during Assembly part-sessions;

4. Decides, in order to simplify the procedure, that Rule 25.4. of the Rules of Procedure be amended as follows:

“Except for the holding of elections, the Agenda may be altered only in accordance with the provisions of Rules 50 and 52.”
