Amendment 13 | Doc. 13078 | 23 January 2013

Signatories: Ms Pelin GÜNDEŞ BAKIR, Turkey, EDG ; Mr Şaban DİŞLİ, Turkey, EPP/CD ; Ms Tülin ERKAL KARA, Turkey, EPP/CD ; Ms Nursuna MEMECAN, Turkey, ALDE ; Mr Fazil MUSTAFA, Azerbaijan, ALDE ; Mr Volodymyr PYLYPENKO, Ukraine, EPP/CD ; Mr Rovshan RZAYEV, Azerbaijan, EPP/CD ; Mr Ahmet Kutalmiş TÜRKEŞ, Turkey, EDG

In the draft resolution, paragraph 8, replace the words "has not resolved the problem that this article can be applied unduly against journalists and others, as stated by the European Court of Human Rights in the case of Altuğ Taner Akçam v. Turkey on 25 October 2011" with the following words:

"has resolved certain difficulties arising from its implementation, thereby decreasing 97.3% of cases opened on the basis of the said article".

Explanatory Note :

The revision of the legislation indeed ensured a 97.3% decrease in the number of the cases. In addition, there are no under-trail detainees charged under article 301 of the Penal Code at present. Therefore, it will be unfair to claim that the revision of the said article had not resolved the problem."
