Amendment No. 1 | Doc. 14787 | 22 January 2019

Compatibility of Sharia law with the European Convention on Human Rights: can States Parties to the Convention be signatories to the “Cairo Declaration”?

Signatories: Mr Mustafa YENEROĞLU, Turkey, FDG ; Ms Emine Nur GÜNAY, Turkey, EC ; Mr Akif Çağatay KILIÇ, Turkey, EC ; Mr Ali ŞAHİN, Turkey, EC ; Ms Serap YAŞAR, Turkey, EC

Origin - 2019 - First part-session

In the draft resolution, at the end of paragraph 4, insert the following sentence:

"The Assembly recognises that the Republic of Turkey has made a reservation to the Charter of the OIC during its accession to state the fact that Turkey remains committed to the principles of democracy, rule of law, individual universal human rights as well as those of a secular state as enshrined in its constitution, and that this reservation also applies to the Cairo Declaration and its contents."

Explanatory note

This paragraph does not reflect the truth concerning Turkey's international commitments. Article 90 of the Turkish Constitution clearly states that any convention on human rights is a superior source of obligatory binding norms.
